Hi,

Our situation is, we have submitted the I-130 in January of 2010 and followed up with the DS-230 and checklist in March. We are not certain where we are exactly in the process. The only communication we have received from the Montreal Consulate is the request for the DS-230 form and to gather documents. We have read about other people receiving and completing the NOA1 and NOA2 forms but we are not certain about when these steps come into play. If someone could explain to us these specific steps that would help us have a better idea of how much time we have to wait.

Also, we are now considering staying in Canada for another year or two, but would like to know if we can withdraw or postpone our application, and if so what the implications are. If we were to withdraw and be told that we cannot reapply for 5 years, for instance, that would affect our decision.

One year is how long an approved petition can be held for you.

If you don't follow up after a year you will have to submit another application and fee.

If you withdraw you can apply again whenever you want - have no idea where 5 years information came from but that is wrong.

Hi,

Where you are right now is waiting in line for an interview in Montreal (this can take 2-5 months approximately, once you get that interview letter you can have your medical, which you will take to the interview with you.

The NOA1 and NOA2 (Notice of Action) are not forms to be filled out, they are forms that are sent out to applicants to acknowledge progress in the I-130 petition - you don't have these as you filed directly with a consulate.

There is no particular amount of time you have to wait if you cancel your application now - you can cancel today and start fresh with a new I-130 tomorrow if you like.

I don't know anything about postponing an application, so can't help with that question.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

They were talking about postponing the application - not just the interview.

Thanks everyone for the responses, that helps. We are interested in postponing the application in general, not just the interview. We're curious if that is possible and if so, if there is any type of penalty, financial or otherwise.

If we can postpone an application without losing our fee then that is ideal. Does anyone know of the actual process to postpone?

In terms of withdrawing our application, I assume the fee is lost. It is good to know that having an unfinished application does not impact future applications.

In that letter, should be some 'max time' reference for submitting the rest of the documents (I-864, DS-230) .

You gots anything like that ?

During our DCF we never received it - just verbal approval and that they're sending it to a different embassy that handles immigration visas (ours didn't at the time, they were just approving I-130s).
