I feel so torn between bringing enough evidence and too much evidence.

I want to be ready to pull stuff out if they ask, but at the same time don't want to go overboard and cause suspicion.

There is nothing as bringing too much evidence. For our (luckily) easy interview I had three attache sized bags with me - one for the real important stuff (originals, primary proofs, copies), one for supplementary proof (basically pick a couple of different bills/statements throughout our years of marriage, early, middle, current + a big binder a lawyer once made us for UK residency), and one bag with photo albums.

Yeah, I probably went overboard with the evidence as I only had to open one folder in the first bag... but I had enough to back things up if asked for.

The guards and the IO didn't bat an eye - they are used to it (the amount of bags/evidence). The shorter your relationship is, the more you want to be able to make sure you can proof things.

Yeah that seems to be the consensus here. Never too much evidence. We will bring everything we have, and if they don't ask for it, that's fine I won't bring it up. But if they do, we will be ready :)

Since I am not paying for it, fine, she can come. She is worried about the intent thing, though. She doesn't figure they will worry at all about the relationship because Canadians are known for NOT wanting to move to the US. The only way they do it is if they fall for someone here, so that is in our favour. However, she feels we are going to get grilled on my intent when I crossed the border, so I have to bring proof that I left all my stuff back in Canada and had a plan for going back to finish off the CR-1 process. Sigh. More to be nervous about.

If I remember correctly you were in the middle of the CR-1 process when you crossed the border right?

That does make for a more complicated case, but I've heard time and time again (and I'm sure you have too) here on VJ, that the negativeness of intent is usually majorly outweighed but the positiveness of being married to a USC. And barring any other redflags, intent alone will not be enough of a negative.

The only problem would be if they could say that you misrepresented you intent at the border.

I remember some mention of things like having documents you would need to file for AOS in your suitcase that they searched and discovered during your border inspection. Stuff like that..

We needed some originals for the NVC step, and I kept my correspondence where I requested it from different agencies, before the final NVC submission, so I am going to take that to show I WAS going through the CR-1 process, then hit the snag where we would be separated for 9 months and couldn't bear the thought, especially since we are trying to get pregnant and I am running out of time for that. I am trying to decide if taking my doctor's records re: the miscarriage is overkill.

I don't think it would be an overkill if you do what everyone here has been telling me to do.

Just bring it with you in case you need it. Only take it out if it is necessary.

I have a feeling 80-90% of the things we're taking with us will not be looked at but I sure will feel better knowing I will have that stuff with me!

Yeah, I have sections for all the regular evidence, and I am going to have a folder solely for intent proof, which I will call "miscellaneous".

ValerieA, I was out of status (due to a mistake by my previous lawyer, yes I know...I sure know how to pick them ;)) and then found a company who wanted to sponsor my H1B. Well, since I'd been out of status they approved the employer's petition but not my change of status. I had to go back to Sweden to apply at the embassy. I was prepared to do that, but was told that it would probably be denied or it could take 3 months-1 year to get approved so we decided to just change our wedding plans and get the legal part done with. Now we are planning the "real" wedding for next year, so that all my family & friends have time to plan & save. I have my story straight, but am a little worried about getting questions about it during the interview too.

I am also feeling homesick today. I did last Thursday, too. I think I need to stop coming on VJ, or at least stay out of OT. Every time I see a thread about "What do you love about the US" (the one today is why you love being a US citizen) I do the comparison, trying to find just ONE thing that is better here than in Canada. Just ONE. The only reason I am here is because of my husband. Don't get me wrong, I like it here, I am comfortable here, but I haven't found any way that it is better than Canada. Especially Toronto. Even the produce sucks! Here I am, living close to where they grow all the produce, and it is a crappier quality and way more expensive than in Toronto! (I worked for a veg processor before moving here, I know my veggies heheh). The owner of said company had told me this, because Cdn retailers sell their produce at a loss while paying for top quality, but it didn't really sink in until I got here.

OK, I think my rant is over. Sorry. And I am sorry if I offend any USC in here. It's not that the US sucks, it really doesn't, it is a GREAT country. It's just that Canada is so wonderful. luv.gif And it doesn't help that I haven't been there for 9 months, and I can't go back until I get my green card. This is my first summer I have not gone back to SK to visit my folks. It sucks. And I know I don't have it nearly as bad as many others on here.
