Since my country give out the Nobel Prize I will nominate you You have done the impossible, you figured out USCIS. I guess it won't be true for me since I got a RFE

maybe because i guess that some types of RFE don't delay the interview letter some do re-start the clock after they resume your case.

i still can't figure what re-start the clock and what it doesn't but i'm working on it

hope yours don't have any change on the time line

that's what i have been working for the past month-

USCIS is run by a software codename CRIS (Central R???? Immigration Service)every application is type in to the system and all the evidence scan ,the system will find if there is any missing evidence and if there is one the application will be send for an immigration officer review after the officer and supervisor agree that it will be need more evidence they send the RFE and add that to the system again ,if there is something simple(yellow level RFE) the system will not stop the clock and the application will fallow a "standard " timeline according to your local office(one month starting from the biometrics appointment letter RECEIVED not the date on the letter ,the system also controls when the letter will be send in the mail, what it may change is the appointment date because of the number of applicant in ahead of you on the line) if there is something more relevant(red level RFE) the system will stop your interview clock and re-start after the case is resume.

also expedite you EAD jump you application to the beginning of the line and "sometimes" to the back again re-stating the clock(according to when the expedite was requested right after the Biometrics taken the application will probably go back on line) .

this are just ideas i do not know anybody that work on USCIS i just compare timelines and posts on this forum i may or may not be right this are just ideas that how the precess works .

I think you might be on to something here

So according to the Felipe theory I would still receive my interview letter a month after the bio, depending on when I response to the RFE. It might be a little later since it took us a while to respond, but we have the same RFE as cbriner so if we would have responded right away I would have had the interview letter next week

what does a red level RFE look like? Is the letter actually red in that case?

So according to the Felipe theory I would still receive my interview letter a month after the bio, depending on when I response to the RFE. we gonna know that on the end of next week, we have until the 26th since we both get the Bio letter on 05/24 postmarked 05/20 let's see

Leigh Ann, what does you letter of verification of non filing look like? We tried to get one and after a lot of trouble they gave my hubby some docs. and said that was it but I just looked at them and it just looks like a weird transcript. We have to go back on Monday. More delays... What did you tell them that you needed and what do they look like? Does it say verification of non-filing on top? It might help to know when I go back to fight IRS again.

no,no,no i mean that the level of the RFE is red(more critical documentation )the letters are all probably the same .

lets say someone is missing the USC proof of citizenship this MAYBE is a red level because they can't confirm the identity of that person so they stop the clock.

Mine was pink!! At least after the attorney scanned it. Maybe that is a level between yellow and red?

Yup, that's what I'm thinking.. by end of next week.

Oh weird. Ours was kind of like a letter. At the top it had my address etc. and then it had "on x date, you requested a verification of non-filing."

Then some other stuff, and then it said, "this can be considered proof of non-filing" (or something like that). Then some other stuff, and then it was signed by an IRS official. I don't have it with me or I'd tell you more exactly what it said, but it was like a letter - and it looked like a response to a request.

I want my interview letter according to the theorem, but I got an RFE too - sigh! Hope it's one of the ones that still comes at the right time. Also, hope I can send it back on Monday! Still need to get in touch w/ my atty though....

See updated timeline. The last time they sent me an RFE it specifically said that my EAD will be on hold. Thsi time it didn't, not sure what that means.

Really weird the e-mail i got it says:

"We received your request to expedite the decision on your application. Your case is currently under review. You will receive a decision or notice of further action shortly."

what did your say?
