June 4th! I know I'm probably being a little over eager, but I'm just so anxious. They sent out biometrics appt on the 31st, and we got it on the 5th so I should be giving them more time, I think.

You will probably get it tomorrow. I'll cross my fingers and hold my thumbs as we say in Sweden. :)

Question, when we filed for my H1B and got a RFE my attorney said that we had only one opportunity/chance to reply to it and so we had to try to send everything we had because there would not be a second opportunity, is that right with these RFE's as well? I don't want to send what we got now and get denied when we could have waited a week or two and sent the official letters etc.

Posted this as a separate topic but no replies :(

I've been lookign around VJ to see if anybody had a similar problem in the past but couldn't find anything..

So I've been here in the US as an F-1 student for a while. Last time I entered the US was in 2003.

F-1 visa expired in 2004 but I am still in school up to currently.

A while back I lost my old (expired) passport along with my F-1 visa and my I-94 in it.

I have copies of everything (except the back of the I-94) and I recently filed for AOS.

I just received and responded to an RFE asking me to prove legal entry into US. I sent them copies of visa, I-94, and all my I-20s.

My questions are:

1) will they want to see the original when/if I have my interview?

I just found out from a couple people here that you can file a replacement for I-94

My problem with that is: when I last entered in 2003 I was actually inspected in Toronto eventually the actual US city I went to was St. Louis, MO.

2) So, what do I enter for place of last admission?

Also, I know that the only way to replace a visa is to leave the country and get a new one - which is not an option because I can't leave the country right now.

3) How much of a problem will all this missing documents be on the RFE specifically and the AOS process in general?

By the way, in addition to having copies of everything that is missing, I also have a boarding pass with an entry stamp (original, not copy).

My old I-20 also has an entry stamp (I have the original too)

So.. verdict? words of advice? (sorry this is kinda long ...)

Thanks !!

1 - I think they want to see originals if you have them - so get what you can, but if it's lost, I think you just have to say so. I'm sure you're not the first person who has lost something.

2 - Place of entry is about the border point you crossed, not about where you were headed in the US.

3 - I have no idea, probably depends on who gets your case, I don't think it's an exact science.

Hmm, I just googled it and read about it. Apparently if they're not satisfied w/ the response to the RFE, then they can send a Notice of Intent to Deny, after which you have one last chance to prove that they shouldn't deny you. Soooo, I'm going to take back what I said earlier and say, maybe you should wait? I'm not sure.

Yeah, I'm not sure either. He tried to get an enrollment verification letter from the school, but they said they were not allowed to send it to his home address so it would have to be sent straight to USCIS (or maybe the attorney's office would work?) and since you have to send all the documents for the RFE at once and in the same packet I didn't want them to do that. It would take at least a few days as well.

That's bizarre. I don't know why they can't just give it to him, but I guess it varies by school or something. What about a transcript? I know it would take a few days, but maybe you could get that sent to you?

Yeah I know. Believe me, I have more than once during this process considered giving up and just bring the hubby with me to Sweden :) He thinks it will be too cold for him though haha!

Haha, I believe him - especially in the North! I brought an African boy to Boston (where I was in school) - he was not appreciative, and Sweden is worse!
