I would send the copy. It is ridiculous that they are asking for it again, but I've heard that they sometimes lose documents that you send them which really should be unacceptable. I have not received mine yet, but our mail gets here late afternoon. Will call my attorney and check if they have received it (talking about unacceptable, my attorney is sooo slow!!) :diablo:

I noticed in your timeline that you were able to get confirmation that USCIS received your RFE.

How did you send it?

I was assuming that to get delivery confirmation you have send it certified mail and someone has to sign over there??

So how did you get confirmation if you said no one can sign for it?

I sent it USPS express mail ....then the next day I called the local postal office in Lee's summit if in fact it got there ....they confirmed and also said it was on the sheet along with all the other packages that were to be given to Homeland Security that day ....the tracking number did confirm that Homeland security picked it up at that time ....the next day USCIS text me to let me know they had it and resumed my case ..... Here is the local number to USPS in Lee's Summit ... 1-816-525-3589 the gentlemen's name I talked to was Ray and he was extremely pleasant and helpful ,,,

OK. so I finally got the RFE letter. Very scary looking 2-page yellow thing.

And it wasn't what I thought at all!

This is what they want:

Evidence of your lawful admission or parole into the United States. Such evidence includes, but is not limited to, Form I-94 Arrival/Departure Record, or a copy of the nonimmigrant visa page of your passport showing admission to the United States.

Ughh.. I already sent them a copy of my student visa. It is expired (but I thought this was OK as long your I-20/student status is valid), so maybe that's why they want something else?

Of course they don't say any reason why they need more evidence.

Do you guys think they want the actual I-94 or can I send a copy? There is no way I am sending any originals!

Besides, they have my I-94 number anyway. They already make you enter it a million times in all those forms!!

Has anyone out there gotten this RFE before?

Should I just send them copies of everything I have? every single I-20 I ever had and every page out of my passport or something?

Do not send your original I-94, you will need it again at the interview. I would send a copy of the visa and a copy of the I-94, and a copy of your I-20 as well. I don't know what mine is for yet, but I came here on a student visa and it is loooong expired, had another visa after that but they never asked for that one. Seems like they are losing documents over there since two RFE's this week in our group were for things already sent :angry:

No, I didn't send the front and back of my I-94 :(

I didn't send it at all because the only form that even asked for it was the i-765 and in the instructions they said you don't need to if you're filing EAD under the © (9) category (AOS)

Anyway I can't send them front and back. I lost my pasport that had that I-94 stapled to it and I only had a copy of the front

(What is in the back of it anyway???)

Hmm.. maybe I need to send them a police report saying that I had lost it and that is why I only have a copy of the front?

Man, I am screwed, aren't I?

And they are so confusing because they don't really tell you exactly why they want the document again

OR if they want something else in ADDITION to it??? :angry:

It is a very generic "we need evidence" sort of letter.

So I don't know if I should send the same thing I already sent or add other stuff they didn't really originally asked for?

But you got your RFE notification right around the same time I did so you should find out what it is soon! Good luck!!!

I don't think I sent a copy of the back. Does it ask for that? The only thing that's on the back are warnings and stuff, no stamps, no signatures or anything. I'm guessing the copy of the front should be enough, since they don't have a copy at all right now (if I understood it right).

Timeline

I sent it USPS express mail ....then the next day I called the local postal office in Lee's summit if in fact it got there ....they confirmed and also said it was on the sheet along with all the other packages that were to be given to Homeland Security that day ....the tracking number did confirm that Homeland security picked it up at that time ....the next day USCIS text me to let me know they had it and resumed my case ..... Here is the local number to USPS in Lee's Summit ... 1-816-525-3589 the gentlemen's name I talked to was Ray and he was extremely pleasant and helpful ,,,

No, I didn't send the front and back of my I-94 :(

I didn't send it at all because the only form that even asked for it was the i-765 and in the instructions they said you don't need to if you're filing EAD under the © (9) category (AOS)

Anyway I can't send them front and back. I lost my pasport that had that I-94 stapled to it and I only had a copy of the front

I did sent them the I-94 front and back copy. I think that there is a form that you can get a replacement of your I-94 arrival/departure record:

Form I-102, Application for Replacement/ Initial Nonimmigrant Arrival-Departure Document

You should use Form I-102 to:

1. Replace your lost, stolen, or mutilated Form I-94, I-94W, or I-95;

Always send copies of front & back of any document issued by USCIS even if there is nothing there (I learned that from my international student advisor).
