Although...I'm not sure what to think about this database...its not very reliable. my I-130 is still at initial review and so is the travel document which i already have approved and in hand. AOS has been touch since June and it say request for evidence under review. Not sure where that tab came from, it wasn't like that before. So needless to say it says what it want to on any given day... :lol:

It has always been before the doc production, but they changed the RFE dot (the wording) and some of the other dots on the other forms. My I-130 is also in Initial Review and my I-485 on RFE. So yes, not very reliable :)

You do not have to pay medicare and SS if you are F-1, provided you have been in the USA less than 5 years. If you have been in the USA for more than 5 years, you are considered a resident for tax purposes and have to pay it. Of course with the GC, we're all residents now. No more 1040-NR.

I am/was on F-1 too. Do you know if we can still file 1040-NR for the year of 2010 since we have been on F-1 status for at least 6 months?

Also I am currently doing a summer CPT. Should I notify my empoyer that my status has changed and pay the medicare taxes?

Definitely inform your employer right away as you need to start paying SS and medicare taxes. You also need to fill out a different form for deductions (forget what it's called) since you're married.

You have 2 options for filing 2010 taxes:

1. Filing as a dual-status alien (separate from spouse)

2. Filing jointly with spouse. If you file a joint return with USC spouse, then you have to be considered (and taxed) as a resident for the whole of 2010.

Personally, I think I am going to go with (2), even though (1) will probably result in more refunds. But the whole "dual status" thing sounds quite confusing, and I don't know if I can do it myself. I don't even know if someone at H&R Block can help me with that, since I had to call around quite a bit before I could even find someone to do my 1040-NR last year. AND they charged me >$500!!!!! :crying:

(I usually file my own taxes but last year I lived in 4 different states so it was quite confusing) :unsure:

But if I did, I'd choose filing jointly anyway because it'll be good for the ROC later :)

Did I miss anyone? unsure.gif There just seems to be so much happening so fast now. adethony, I hear you. I have gotten the impression, when I checked out the other May AOS filers forum, that the ones that get transferred have to wait longer, so even if there is no interview to stress over, it doesn't seem quite fair. Unfortunately, there is a lot of stuff that seems unfair in immigration. I think that is why we get so much passive-aggressiveness from the K-1's and CR-1/IR-1's when someone comes on wondering if they can AOS from a tourist visa.

So, I got this notice today on the website. Never once have I received an email or text, even though I have it selected in my profile. Go figure. Anyway, back on the 23rd the site said EAD card production ordered. So, what could this letter possibly be?? The dot also changed to post decision.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

We haven't received the card, but our interview is only 2 weeks away......eeeeek Gettin' nervous.

They mailed the card on 8/4. I don't know why they have the system this way b/c everyone gets confused, but you get different notifications when it's ordered and when it's mailed, and the dot goes backwards on the status. Silly USCIS....

Hubby had the common sense to make sure my name is spelled correctly and all..
