NEWBIE needs help...please!!!!!!!!

I am new to VJ but am very eager to learn more about the K1 process. My bf and I have been together over 6 months now and know we want to spend the rest of our lives together. We met while I was on holidays in Barcelona and have been doing the long distance thing ever since. He has visited me in FL and I have returned to Barcelona. Next step is for him to come to USA for longer . We plan him coming for 90 days at a time on the visa waiver while we begin the K1 process. Does anyone know for how long he must leave the country (USA)?? And will he be harassed by immigration upon entering for staying with his gf for 90 days at a time. ( He said they asked a myriad of questions when entering for 2 weeks!) How many times can we do this process before actually committing to get married? Any help would be greatly appreciated regarding VWP and K-1. Our bottomline is that we want to get married on our own terms and are willing to doing the VWP procedure until we are exactly ready for this comittment. I have a feeling it won't be long, though!wink.gif

well as far as the first part goes, i really don't know, but the k-1 process isn't really that hard. Just gather enough evidence such as photos, emails, handwritten letters, your passport stamps indicating the date you visited him, the k-1 visa process is here at the website, you just file an 129f petition, pack with evidence, and wait for a couple months, just check out this link My link

Entry with a non-immigrant pass, either VWP or a visitor's visa, is always up to the discretion of the CBP officer. If they think there's a risk you will overstay or try to adjust status, then they'll turn you around and send you back home. The more frequently you do it, the higher the risk. They may see that having a fiancee in the US also increases the risk. Because it's totally discretionary, nobody can say for sure at what point he'll be denied entry. Sometimes, all it takes is one wrong or inconsistent answer to a question.

Read this forum for general information about the K1 petition process, especially the "sticky" threads at the top. Read the US Embassy reviews for your fiance's country to get an idea what the interview process will be like. Read the Europe regional forum to get more insight into the visa application process at the foreign consulate.

First and foremost, don't start anything until you are absolutely certain you are committed to each other. The K1 is not for boyfriend/girlfriend relationships. It is for people who are engaged and committed to be married. For now, just read and learn what you can.

In the case of a K-1 petition, after submission you are looking at at least several months of waiting on the VSC before you'd receive your NOA2 approval -- if not longer. During that time, your fiancé would normally remain in Spain for the duration, as any attempt to enter the U.S. could be construed as being motivated by a desire to immigrate prior to receiving the visa itself. Technically, you two could marry while he was on a tourist visa and then adjust his status, but for the very same reason -- you are already in a relationship -- that would not be permissible. Most folks would say it is fraudulent. But it happens.

I'd personally suggest educating yourself on the entire process, and focusing on putting together all of the supporting evidence required for a successful approval and subsequent interview. It's difficult to be away from your loved one, but even six months apart is a small price to pay for the rest of your lives.

Of course, you can visit him as often as you like without having to jump through immigration hoops to do so.
