Urgent Removing Conditions advice needed

Timeline

Hey Everyone

i know that some of you already know me ,,it has been a while since i logged as ofbeing busy establishing my new life here

one of my friends have a problem andi was unable to help him unless im sure what to say , so here is all about it :

he got married and he arrived to the united states and got two year conditional card

he been here for 8 months , his relation with his wife is not well and she left the house hold and refuse to go back after a fight last friday

she left , dont answer the phone , the very next day she withdraw all the money from all the joint accounts and she also took money from his personal account through phone using his info(without authorization from him ) , actually she left $180.00 , left him without a car to go to his work, little food at home

finally today she sent him an email telling him she finished all the bank business, that she will remove her name from the apartment lease and its up to him to stay or leave to another place, also she managed for electricity and cable to be outby 6/1 , he doesnt even have a cell

he send her an email back asking her to get back home and to work things together and even they can council and do whatever it takes to work it out , but she answered back showing that she insist and that he got married to her for immigration only ...

so as of what happened above, and as i know he will need to remove condition with a waiver , here is what he have :

1:2009 and 2008 joint tax return

2:joint checking and savings account statements

3:a copy of the apartment lease that hold both their names on it

4: credit card joint account that show both their names

5: an old 401K that show him as the beneficiary (this documentation is old and cant get a new one as she chaged the access password to the link tht he can get that now ...

6: pictures for him and her all that time period and with her family in different occasions like halloween and her sister wedding as well

7: sworn affidavits from two of his and her friends that witness an ongoing relationship during all that time

so here is my Questions :

1: what is his chances to get the conditions removed without troubles ?

2: if she sent USCIS a letter stating that this marriage was to evade immigration laws , what is the impact ?

3: If and Only IF he is to meet someone that he likes and got married t (USC) before he lift the condion OR through the process of lifiting the conditions , will that change anything or what steps he should take if he got married ?

Your friend needs to get divorced and then file as soon as possible for removal of conditions (deadline of 90 days before his 2-yr green card expires still stands so he has some time).

I also moved this topic from AOS to ROC forum.

1.) None of us can predict that, but people who are divorced and apply with a waiver are approved all the time.

2.) It certainly doesn't help him any, that's for sure. If he has any inkling that she may do that, I'd be inclined to have an immigration attorney help him with removing conditions. This would be a fly in the ointment which would change his case from a routine filing with a waiver to something more complex.

3.) He received the 2 year GC on the basis of this marriage, and that GC is due to expire soon. He still has to remove conditions on that green card, based on the marriage in which he entered the US. Marrying another USC wouldn't do him any good in that process. But, if for whatever reason the removing conditions application were denied, the new marriage might help him some - again, ask this of an immigration attorney.

I just hope he's not already looking at that as an option. Otherwise I'd be inclined to agree w/ his wife as to why he married her.
