Naturalization under the INA 319 (b)

Hello everyone,

Okay, so a few days ago I sent my Application for Naturalization under Section 319(b) of the INA to the Vermont Service Center requesting and clearly stating on my Cover Letter that I would like to be interviewed and naturalized in the Fairfax, Virginia Local Office.

Today I’ve received a Notice of Action from Texas Service Center asking for Biometric Fee even though that I’ve sent them two sets of Fingerprint Cards taken in a Military Installation in Afghanistan.

Now my question from you guys is that why do you think my case was transferred to Texas Service Center if I wanted to be interviewed and naturalized in Fairfax, Virginia? Also don’t these people go through the paper works enclosed with the application and see what is in there before they ask for something that is actually enclosed in there or they’re just freaking blind and too dumb?

Because Texas Service center receives applications for N400 for the East Coast and Virginia is in the East Coast, right?

Arizona is for West Coast and Midwest.

Call USCIS about the biometrics fee - if you already sent the FP cards, you should be ok. They are used to seeing the $675 on the check instead of $595.

Mathew Mael,

Have you stated in your Cover letter that you are enclosing the 2 fingerprint cards and that you are currently out of the states in Afghanistan on Government orders with your spouse?

If you haven't done so, they might have thought that you are still in the states while applying for the INA 319 (b) especially if you have provided any address in the states other than your APO add. or your physical address in Afghanstan.

And have you written the address as follow?

Vermont Service Center

75 Lower Welden Street

St. Albans, VT 05479

Attn: Expedite Naturalization – 319(b)

Those are some of the important keywords when applying for N-400 under 319(b), if you have forgetten to do any of the above then try to contact Fairfax office @ WASN400.OVERSEAS@DHS.GOV try to explain them your situation, you may get help or at least direct you to where you can get help.

Sounds like you and I are in the same boat. My wife filed her N-400 back in Feb under 319b along with 2 fingerprint cards taken at the MP office on Funari Barracks in Mannheim, Germany. I only enclosed a check for $595 and received a notice saying that we owe another $80 for biometrics. I called the USCIS customer service and they said they couldn't help and that I should make an infopass appointment. I emailed the USCIS field office at the Frankfurt embassy and they weren't of much use either. I ended up just mailing them another check for $80 and received another letter saying that they had received payment and that my wife would be scheduled for biometrics. We still haven't received a biometrics appointment letter yet so I'm not sure whats going on at this point. Its been about 3 weeks since they cashed the $80 biometrics check.

FYI, I also sent my wife's N-400 to the Nebraska office and then it was transferred to Phoenix office.

If I don't hear anything soon, I think we'll make an infopass appointment at the Frankfurt embassy and hopefully try to get some answers.

03/17/2010 - Check Cashed

03/26/2010 - NOA received requesting additonal payment for Biometrics even through 2 fingerprint cards were supplied with the application.

03/29/2010 - Mailed additional check for $80

04/12/2010 - Biometrics check cashed

04/19/2010 - NOA received saying that payment for biometrics was received

05/11/2010 - Email alert saying case is now in Testing and Interview status. Waiting for interview appointment.

06/15/2010 - Passed Naturalization exam. Same day Oath Ceremony

06/17/2010 - Applied for US Passport

Have you filed before leaving the states?

Sorry SandLand I included your name by mistake.

But why did you contact Frankfurt office? why didn't you contact Phoenix office or Nebraska where you've filed for you wife, or the office which have sent your wife the NOA with the biometrics fee, to explain them the situation? Frankfurt or any overseas office don't process INA 319(b) cases, the only do INA 319(e), that's why they weren't much of a help in your case.

For the biometrics NOA try to contact the field office where your wife stated that she wants to be inteviewed at.

My experience doesn't apply to N-400 but I was in a similar situation when I filed for removal of my conditions. My husband and I were stationed in Germany at that time and just like you, I included my fingerprints cards. I never paid the biometrics fee either but received a regular NOA1 and they cashed my check. Months and months went by... a year went by... and I still hadn't heard about my case. While visiting the US, I made an InfoPass appointment at a local office. They told me my case was on hold until I return to the USA (after my husband's Germany tour) because they couldn't read my fingerprint cards and I would have to get my biometrics done at a local office. Two years later (after receiving orders and moving back to the US), I contacted USCIS, they took the hold off and I was finally able to have it processed. It took over 2.5 years total (see my timeline).

Filed my N-400 end of February 2010. Mid April, went for my fingerprinting. Today I received a yellow letter stating what documents to bring for interview IF not previously submitted. No mention of date and time of interview though so I'm assuming I'll be receiving shortly???

I was getting a little nervous that my wife still hadn't received a biometrics appointment. Then I received an email alert this morning from USCIS that they are scheduling her interview. I confirmed on the CRIS case status page as well. Below is the email I received. Evidently, my wife's biometrics are still valid. I wonder if they'll refund the biometrics fee... :) I'm sure they won't.

My wife just received here interview appointment for June 15 at the Fairfax, VA office... I'll let you know how it goes.
