aussiewench,

Thanks for correcting me.

My appologies to rebeccajo.

The new rules regarding the I-864 now only require 3 times.

Q. My sponsor and/or joint sponsor is using significant assets as part of his affidavit of support. Does the final rule change the requirements for significant assets?

A. Yes. The final rule reduces the value of assets that immediate relative spouses and children of U.S. citizens must have to fill the gap between earned income and the poverty guidelines from five times the difference to three. The gap is reduced further for those sponsoring adopted children who will qualify for citizenship under the Child Citizenship Act, but who do not qualify immediately upon entry.

New Rules

Lorelle

rebeccajo,

5 times. When using I-864.

There is no comparable 'rule' for non-immigrants, although there may be local guidelines for determining whether a K-visa applicant meets the public charge provisions of the law.

If you have verifiable assets you can supplement the shortfall providing they are at least 3 times the amount of the shortfall.

Mew,

I doubt it - there are much better ways to show one's income and not everyone deposts their pay into a bank account.

I believe that they are primarily looking to know how much of a 'cushion' one has if income is marginal. (And if the information is provided, they might be curious about deposits that are not consistent with income.)

So sending a copy of paystubs, and a letter from my employer regarding my salary would be enough?

What about Bank Statement, are they looking for certain amount of savings in my Bank?

I'd say they're maily looking for how much money you've deposited in the past year, to show income (so they can assess whether you meet the 125% thing).

No, you can file with other evidence of income.

Paystubs, as many as you can produce.

A letter from your employer (on company letterhead paper) verifying your annual salary.

With this, you should be ok. Do not wait for a 2006 tax return, there are other ways to verify sufficient income.

Best of luck to you all.

does the salary have to be in annual terms? i've asked our HR to write me the Proof of Employment letter...it's so friggin' simple it's one paragraph (i offered to write it)...but she wrote my biweekly gross instead of annual gross. i asked her to change it to annual and i don't think she heard me right because i got it back and it still says the biweekly gross. i'm getting a headache i don't even feel like asking her anymore. :angry: can i just attach my job offer letter? that one has my annual salary.

From I-134:

The sponsor must submit in duplicate evidence of income and resources, as appropriate:

...

B. Statement of your employer on business stationery,

showing:

1. Date and nature of employment;

2. Salary paid;

3. Whether the position is temporary or permanent.

I only offer advice - not even legal. Just the plain and simple kind.

i know it doesn't say it specifically but i'm comparing it to the poverty guidelines...which is spelled out according to annual gross. i'm wondering 'coz in Manila Embassy...a non-US citizen employee checks all the supporting docs before you get to meet the CO and i think they'll look at the current income. do they have to multiply the biweekly gross to the number of weeks in a year divided by two?

ahh...i'll ask her tomorrow. :help:
