Today we received forms DS-3032 and are eager to pay the fee to kick this next stage off, but I would like to clarify whether or not we can file an adjustment of status from an E2 Visa instead.

We have been in the USA on a E2 Treaty Trader/Investor Visa since 2006, our E2's aren't due to expire until 2013. We own and run a Print/Copy Store. We originally filed the I-130 back in 05/2002. As we are already in the USA can we just file the I-485 along with I-508 (waiver of rights privileges Exemptions & Immunities). 10.(I) of the I-485 instructions imply that we can (if I read this right) but I may be wrong.

I don't really know much about the adjustment of status, I do know that we would not have to return to the US Embassy in London for the interview/approval but is it any quicker than going ahead with form DS-3032.

Any advice would definitely be appreciated.

Thanks
