Stop Guessing: ACTUAL BILL SB 1070

If you get pulled over and you cannot be legally identified (even if you're white) you're going to be arrested so they can figure out who you are..

This isn't the overblown big deal people are making it out to be.

Obviously it remains to be seen how this will manifest itself. Many people, myself included, are concerned that USCs will have to start carrying around proof of citizenship to avoid being detained while citizenship status is checked. Under this law, a naturalized USC with a current driver's license, for example, may have to produce a US passport or naturalization certificate if an officer has "reasonable suspicion" that he/she might be illegal (of course, what may constitute reasonable suspicion is anybody's guess).

What makes all this even trickier is that a lot of people here illegally have current, valid licenses. I live in AZ and my brother is a former border patrol agent and now deportation officer, so I do get that we've got a big problem on our hands. But this law is pointless and is clearly designed to create the illusion that something big is being done. It certainly will not, as its proponents suggest, "stem the tide" of drug & human trafficking, etc. Illegal immigrants who are arrested are already being turned over to ICE in large numbers. What really needs to be done in this vein, among other things, is more official cooperation between DHS and local authorities, but this will require a sort of cultural shift (by cultural, I mean among law enforcement entities), which is another topic altogether.

you can say that anytime/anyplace/anywhere in this nation... The bill prohibits discrimination on skin color, race, etc. - Individuals act like turds sometimes. Nothing is ever going to change that.

I'm just saying the guy isn't exactly providing a neutral opinion on the issue. He's got a vested interest in the case against the bill.

It was quite selective to go on a tangent about Manheim's past cases while conveniently ignoring Chemerinsky's credentials.

He is a prominent scholar in United States constitutional law and federal civil procedure.

To simply dismiss their legal opinion on the matter, especially from a guy who pretends to be a constitutional scholar is just funny.

No you don't get it. The State police haven no business enforcing Federal immigration laws - that is the purview of Federal Agencies like Homeland Security, ICE and the Border Patrol.

The law amounts to grandstanding at best (sounds good but is practically worthless), or institutionalised racism at worst.

Karl Manheim of Loyola Law School in Los Angeles and Erwin Chemerinsky of UC Irvine Law have stated this law is DOA. It's unconstitutional.

The Arizona law appears to be “facially unconstitutional,” Manheim said. “States have no power to pass immigration laws because it’s an attribute of foreign affairs. Just as states can’t have their own foreign policies or enter into treaties, they can’t have their own immigration laws either.”

It's a good thing that the law isn't stuck down because two lawyers "state" that it's DOA. They can "state" whatever they like until they're blue in the face, but it doesn't make it so.

What's really good is that they have to prove it. That's the way the law works. Have at it.

Albert Gutierrez is a former Arizona state senator and he was interviewed this morning with Larry Mantle. He said that there is no bail available for suspected illegal immigrants, so if you are pulled over and the police have 'reasonable suspicion' you are not here legally, according to this law, they can detain you indefinitely until you prove your legal status. This is an over-reaching, gestapo-like law that won't hold up constitutionally. In the meantime, it will be another stain on the state of Arizona as many groups are planning to boycott the state. What an embarrassment for us Arizona natives who don't get worked up over an issue that doesn't have any real personal negative impact on our lives.

Apparently, Albert Gutierrez has not actually read the bill. It doesn't require YOU to prove ANYTHING to the cops. It requires the cops to make a reasonable effort to determine your status with federal authorities. Nowhere in the bill does it say they can detain you indefinitely while they attempt to make this determination. The provisions in the bill regarding detaining and remanding people to federal authorities all refer to people who have already been determined to be in the country illegally.

I'm amazed at the degree to which people are spinning this. I read an article this morning where the commentator said that the bill will require cops to punish victims in a crime if the victim is suspected to be an illegal, and then made the claim that the punishment for the victim was worse than the punishment for the perpetrator. Nowhere did he mention that an illegal alien IS a perpetrator of an immigration crime, and that deportation is NOT a punishment under the federal law.
