Adjustment of Status Questions

Hi All,

My fiancé's K-1 Visa Petition has been approved. I will be traveling to India during the month of May to bring her to the U.S.

I have a few questions as I am going through the guide to AOS on VJ.com.

I-485 - Only one copy is required, I don't have to make multiple copies?

G-325A - Do I (Petitioner) have to fill this out as well? Can I use copies of the originals that I sent over to USCIS when I filed for the K-1 Peition? Do I also need to make 4 copies, a process similar to when I sent the I-129F packet to the USCIS office.

I-693 - My fiancé has already had her medical done in Hyderabad, with that being said -

A). She is not required to have another medical examination as long as the form I-485 Application to Register Permanent Residence or Adjust Status,is filed within one year of your overseas medical examination.

B). We will, however, be required to complete Part 1,information about my fiancé,and submit the vaccination secton of Part 2 with your adjustment of status application. A designated civil surgeon must complete the vaccination section and Part 5 of the Civil Surgeon Certification.

There is also a mention that "Some people have submitted a DS-3025 with their AOS package and have NOT received RFE's. Some HAVE. If you want to be absolutely safe in terms of your medical documentation as a K-1 adjusting status, you should take your DS-3025 to a USCIS-certified civil surgeon and ask them to transfer the information from your DS-3025 to an I-693. They should do this for a nominal charge. If they try to tell you you need a full medical examination, DO NOT LISTEN. You ONLY need the vaccination part. The following memo from the USCIS documents that this completed form will remain valid beyond one year when submitted with most Adjustment of Status applications."

Question - How do I go about finding a USCIS-certified civil surgeon? Can I do this when I travel to India?

Question - We will get married after coming to the U.S. In this case do I need to send in a copy of my marriage certificate?

Question - I have already filled out 1-134 Affidavit of Support when I sent the documents to my Fiancé. I still am required to fill out I-864 Affidavit of Support. My Joint Sponsor would have to do the same?

I know these are quite a bit of questions. But hoping someone can help answer these.

Thank You,

Nishi

Hi All,

My fiancé's K-1 Visa Petition has been approved. I will be traveling to India during the month of May to bring her to the U.S.

I have a few questions as I am going through the guide to AOS on VJ.com.

I-485 - Only one copy is required, I don't have to make multiple copies? ONLY COPIES FOR YOURSELF

G-325A - Do I (Petitioner) have to fill this out as well? Can I use copies of the originals that I sent over to USCIS when I filed for the K-1 Peition? Do I also need to make 4 copies, a process similar to when I sent the I-129F packet to the USCIS office. ONLY FOR THE APPLICANT. THERE IS A NEW VERSION WHICH ONLY REQUIRES 1 PAGE

I-693 - My fiancé has already had her medical done in Hyderabad, with that being said -

A). She is not required to have another medical examination as long as the form I-485 Application to Register Permanent Residence or Adjust Status,is filed within one year of your overseas medical examination. IF SHE HAS THE VACCINATION RECORD SHE CAN TAKE THAT TO A CIVIL SURGEON IN THE USA WHO CAN TRANSCRIBE THE RECORD TO THE I-693 WHICH YOU WILL NEED TO SEND IN FOR AOS. SHE MIGHT REQUIRE ADDITIONAL VACCINATIONS AS WELL.

B). We will, however, be required to complete Part 1,information about my fiancé,and submit the vaccination secton of Part 2 with your adjustment of status application. A designated civil surgeon must complete the vaccination section and Part 5 of the Civil Surgeon Certification. CORRECT

CHECK THE USCIS HOMEPAGE, THERE IS A LINK TO FIND A CIVIL SURGEON

Question - We will get married after coming to the U.S. In this case do I need to send in a copy of my marriage certificate? YES, CERTIFIED COPY

Question - I have already filled out 1-134 Affidavit of Support when I sent the documents to my Fiancé. I still am required to fill out I-864 Affidavit of Support. My Joint Sponsor would have to do the same? YES

I know these are quite a bit of questions. But hoping someone can help answer these.

Thank You,

Nishi

I-485 - Only one copy is required, I don't have to make multiple copies? To send? If you mean to send no. It is wise to keep a copy for yourself though

G-325A

Question - Do I (Petitioner) have to fill this out as well? No. You are irrelevant now. She fills in the forms as they pertain to her. You only complete the income stuff.

Question - Can I use copies of the originals that I sent over to USCIS when I filed for the K-1 Peition? No. Because the date on the form is too old. Also, at the time of filing you will have a spouse and there's a section on the form for that. Your fiance (then wife) will also have changed address, possibly have stopped work, and will now be married (maybe changed her name too)

Question - Do I also need to make 4 copies, a process similar to when I sent the I-129F packet to the USCIS office. No. That's the old form. The new form is only 1 page

I-693 - My fiancé has already had her medical done in Hyderabad, with that being said -

Question - How do I go about finding a USCIS-certified civil surgeon? Can I do this when I travel to India? No. The AOS process is conducted in the US AFTER you have married your fiance in the US. Here's the Civil surgeon locator: https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=CIV there is also a thread that talks about ones that are good who don't try and charge for a medical here: http://www.visajourney.com/forums/topic/231026-civil-surgeons-who-dont-rip-you-off/

Question - We will get married after coming to the U.S. In this case do I need to send in a copy of my marriage certificate? Yes. Otherwise you can't file AOS

Question - I have already filled out 1-134 Affidavit of Support when I sent the documents to my Fiancé. I still am required to fill out I-864 Affidavit of Support. My Joint Sponsor would have to do the same? Yes. If your joint-sponsor lives with your they will need to complete I-864A. The I-864 is a binding contract and has different requirements to the I-134

This thread has everything you need: http://www.visajourney.com/forums/topic/235331-aos-ead-ap-from-k1-the-aussie-way-doc-list-included/ I have also answered your questions directly in red in your quote box above.

Good luck. Hope that helps.

Hi All,

My fiancé's K-1 Visa Petition has been approved. I will be traveling to India during the month of May to bring her to the U.S.

I have a few questions as I am going through the guide to AOS on VJ.com.

I-485 - Only one copy is required, I don't have to make multiple copies?

Keep a copy at home just in case.

G-325A - Do I (Petitioner) have to fill this out as well? Can I use copies of the originals that I sent over to USCIS when I filed for the K-1 Peition? Do I also need to make 4 copies, a process similar to when I sent the I-129F packet to the USCIS office.

No, only for her/him. You need to do a new form since her permanent address has changed = living with you now. The new form is only one page, no copies requried.

She had her DS-3025. We took that to a CS and had them transcribe the results onto the I-693 and submitted both. Follow the VJ Guides and don't interpret the instructions.

Question - How do I go about finding a USCIS-certified civil surgeon? Can I do this when I travel to India?

No, CSs only reside in the US. Go to the USCIS website and do a search.

Question - We will get married after coming to the U.S. In this case do I need to send in a copy of my marriage certificate?

Yes

Question - I have already filled out 1-134 Affidavit of Support when I sent the documents to my Fiancé. I still am required to fill out I-864 Affidavit of Support. My Joint Sponsor would have to do the same?

Yes X 2

I know these are quite a bit of questions. But hoping someone can help answer these.

Thank You,

Nishi

I have a few questions as I am going through the guide to AOS on VJ.com.

Do I also need to make 4 copies, a process similar to when I sent the I-129F packet to the USCIS office. You don't need to fill out. Only your to-be-wife need to fill out. The new version of form have only 1 page.

I-693 - My fiancé has already had her medical done in Hyderabad, with that being said -

Question - We will get married after coming to the U.S. In this case do I need to send in a copy of my marriage certificate? Yes, photocopy of your certified copy of marriage certificate.

Question - I have already filled out 1-134 Affidavit of Support when I sent the documents to my Fiancé. I still am required to fill out I-864 Affidavit of Support. My Joint Sponsor would have to do the same? Yes, you have to filed I-864 again as it is different from I-134.
