my wife is very sick and she is a us citizen an she has beenin hospait al now for 2 weeks becuz of a asthma attack,,,,, she has jus woke up been in intesive care the whole time an sedated ...i have applied for a tourist visa an deined becuz of not enufff ties last year .......but she is sick an want to be with her an take care of here ............we have filed bothe i 130 an 129f but none have been approved yet...........my question is do think if i go to the embassy they would consider me for an emergency tourists visa an if so wat do i need to tkae to prove dat she is sick or show dat the it is an emergency?

Sorry to hear that. You can try for a tourist visa with the physician letter and medical report. In the meantime, fax the California Service center a letter with your signature about the situation. They will perhaps expedite the approval. Its fax number is: 949-389-3441. You should address your letter to the Dicrector of the USCIS, California Service Center. Also please include the medical report, physician letter along with the letter. When you write provide names, date of birth of you and your wife. Also include the I-130 USCIS Receipt number and specify who is the petitioner and who is the beneficiary. Please keep us posted.

It took 92 days for I-130 to get approved from the filing date

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Look at the OP's timeline.

Why does he have two pending Visa applications? One being a CR1, the other a K3.

He was denied a Tourist Visa, due to not having enough evidence of ties to Jamaica.

Make your own assumptions.

If she's your wife; why are you in Jamaica, instead of here in the US beside her? Seems to me like you're just trying to use her medical condition as an excuse to get back into the US.

Sorry to say this, but your spelling and ghetto-way of expressing yourself towards me would explain why you really were denied.

Not only don't you know how to write correctly, but you also don't know how to control your bursts of anger as to carry yourself correctly and talk properly to people.

if the way in which u talk to ppl is any indication of how one should talk to people ill take that as a compliment.......next time try asking questions before you start to assume what the situation is, an make an ### of your self............ but u are correct with one thing i shuold not have responded to u because as the saying goes dont argue with fools ppl from a distance cant tell who is who.

dmartmar, where's your timeline? What are your intentions?

People with foreign spouses often apply for two visas because that's how the K3 works. You sumbit I-130 for the immigrant visa, followed by the I-129f for the non-immigrant visa.

People here generally do this without an attorney, and consult with one another for information and support. So it's crucial that this be an environment where people from all over the world can get help during a stressful period. Personal attacks have no place.

Also, many people are denied at the border because of insufficient proof of ties to their home country. It doesn't mean they're permanently barred from entering the U.S. It means they have to assemble enough evidence to convince the border official they'll return home, if they want to try again.

Savanphil, I'm sorry your wife had an asthma episode and hope she's on the mend. Perhaps they'll be compassionate and let you visit. In any case, start working closely with her friends and family so she has people looking after her when she's released. You are in our prayers.

Oh how terrible to be in another country when your wife is sick in the US!

You can apply for a Humanitarian Parole which would bypass the entire visa process entirely and then apply for a adjustment of status when you get here.

This is a little know method of getting a spouse here quickly and the only problem is that when you apply for it, it cancells your I-129f and I-130.

You also need to fill out a I-131 Application for travel document and a I-134 Affidavit of support, file them and you will get a quick answer. Get an attorney or parallegal to help if you need, but in cases like yours they most likely will allow it.

I have only ever seen posts from people who applied and did not get it.

its independence weekend here injamaica it means the offices at embassy are closed until tuesday im jus trying to get all hte info i can to explore all my options on how get to my sick wife......... plus usics is pointless to call the customer care number there they never help or give ne info we all know that...........as far as im concerned the ppl on this site are more helpfull now that i have some suggestions on what to do i will look in to them thank u all for the support and for the information if ne body has ne more info pls post
