K1 Visa Approved, Next Steps.....

Hi Everyone,

My fiancé's K-1 Visa has been approved. I am very thankful to VisaJourney and all of its members for helping me through this part of the process. Now that her K-1 Visa has been approved, I want to know about the next steps in terms of "Adjustment of Status" and getting the Green Card. How do I go about that part of the process. How long is the K-1 Visa valid for?

I will be going to India during May to bring my fiancé to the U.S. and as I arrive into the U.S. we will get married.

Hello, Nishi.

We're about to mail our AOS paperwork today :), I could tell you that AOS is just about the same as I-129F, I think less paperwork too. It's all about filing forms. :)

I don't think there's anything big that you need to be prepared for except reading this forum about the vaccination supplement requirement for AoS. I think this is somewhat the gray area in the AOS step.

Also, get your fiancee, SSN and ID when it's possible, it'll make life much easier.:) State like CA requires applicant to have his/her I-94 above 60 days to obtain an ID.

Other than that, enjoy and get married within 90 days after your fiance enters the US! :) and Congratulation for your approval :)

We are just filling out AOS forms and are confused about a few things.....

Originally during our NOA2 we had to fill out the 134 for all the money stuff to show I wouldn't become a public charge etc, now that we've been granted the fiance visa, I'm in the states and we are married, we're filling out our AOS and now have to fill out an 864. We originally sent in the past three years of HIS taxes (2006, 2007, 2008) in order to get this far; we're worried as we just filled out the 2009 and it's lower than the poverty guideline even though he's been running his own business because of tax deductions as well as alimony to his ex wife.

Should we send in all the same information we sent in LAST time with this new 864? Why the change from 134 to 864? If we send in the old documents with the 864, and they say they need more from this year, or that he needs a cosponser, will that mean I have to leave the country if this is taking place while my fiance visa expires (even though we are married)? Would we just have to refile, or get his parents to cosponser?

There is another Forum which is just AOS issues. Other questions would probably get better or faster answers if posted in that forum.

No one here should suggest sending the same taxes as before, 2006, 2007, 2008. You are then hiding known information from the government.

You should include tax forms for the last three years. Include W-2s and 1099s or else order tax transcripts from the IRS. They are free. 2007, 2008, 2009.

If possible, the easiest thing to do in this situation is to get a "joint sponsor" as you suggested. His parents would be fine. Actually just father or just mother.

As a side note, I read in a posting last night by a very senior and respected member that the USCIS switched from I-134 to I-864 in 1996 because the I-134 is not legally enforceable and the I-864 is worded to be legally enforceable. I cannot say if this is true or not.

Thanks all for yours comments, however I have a few questions as I am going through the guide to AOS on VJ.com.

I-485 - Only one copy is required, I don't have to make multiple copies?

G-325A - Do I (Petitioner) have to fill this out as well? Can I use copies of the originals that I sent over to USCIS when I filed for the K-1 Peition? Do I also need to make 4 copies, a process similar to when I sent the I-129F packet to the USCIS office.

I-693 - My fiancé has already had her medical done in Hyderabad, with that being said -

A). She is not required to have another medical examination as long as the form I-485 Application to Register Permanent Residence or Adjust Status,is filed within one year of your overseas medical examination.

B). We will, however, be required to complete Part 1,information about my fiancé,and submit the vaccination secton of Part 2 with your adjustment of status application. A designated civil surgeon must complete the vaccination section and Part 5 of the Civil Surgeon Certification.

There is also a mention that "Some people have submitted a DS-3025 with their AOS package and have NOT received RFE's. Some HAVE. If you want to be absolutely safe in terms of your medical documentation as a K-1 adjusting status, you should take your DS-3025 to a USCIS-certified civil surgeon and ask them to transfer the information from your DS-3025 to an I-693. They should do this for a nominal charge. If they try to tell you you need a full medical examination, DO NOT LISTEN. You ONLY need the vaccination part. The following memo from the USCIS documents that this completed form will remain valid beyond one year when submitted with most Adjustment of Status applications."

Question - How do I go about finding a USCIS-certified civil surgeon? Can I do this when I travel to India?

Question - We will get married after coming to the U.S. In this case do I need to send in a copy of my marriage certificate?

Question - I have already filled out 1-134 Affidavit of Support when I sent the documents to my Fiancé. I still am required to fill out I-864 Affidavit of Support. My Joint Sponsor would have to do the same?

I know these are quite a bit of questions. But hoping someone can help answer these.
