Hey guys,

I've a question now. If I started working before receiving my EAD card, will that affect my AOS. Will it be a problem during the interview? I'm not working yet, but I applied for a job and it seems working out right now. When I was filling up my forms I was not working so I said not working. What do you think about that?

No I'm on J1 visa. Not authorized without the permittion of the DHS. But I'm asking if I did does that affect the decision regarding my AOS?

Actually the job is part time but 25hrs/week lol 5 hours extra

The place of your employment is committing a federal crime and can be prosecuted if you are paid for those additional hours. My wife worked at Harvard during her time in undergrad and once payroll and human resources realized they missed her status, they immediately apologized and told her they will have to revert the time and be reimbursed for the money for fear of the government coming down on them.

Sadly, it's pretty serious. You can only work at the school you attend (i.e., on campus employment), so I'm assuming this will be the case for you.

As a J-1, can't you apply for CPT? That's what I did. (I'm an F-1 but I think J-1 is allowed CPT too.)

I might not have to use my CPT authorization though, because the day after I applied for CPT I got a text telling me my EAD card has been ordered for production.

02/04/10 - AOS package sent to Chicago Lockbox by USPS Certified Mail

02/07/10 - Package received

02/12/10 - NOA Notice Date

Personally, if you already filed for AOS, then whats the point in trying to gain employment before EAD receipt? I'd just wait. If you are concerned about working unauthorized prior to AOSing, then your unlawful employment will be forgiven, if on the basis of marital filing.

Sometimes opportunities don't wait. And even though overstays and unauthorized work is forgiven after AOS, why start now, when I've taken care to remain in status and follow the rules the whole time?

The OP asked a question and I answered. Not directed to you, sorry. But since you replied then let me address it. Once you file for AOS, you are no longer under F-1 status so you really had no need to apply for CPT as it was basically unnecessary as the filing of ADJUSTMENT of Status meant you were giving up your F-1 status to apply for a Green Card. SO I guess you applied for CPT on April 22nd which was not needed as your are no longer considered an International/Foreign student after filing you AOS Feb 4th.

Understood, and sorry for any confusion.

In regards to the CPT, I am being as conservative as I can. Before I applied, I consulted with my International Students Office and explained my situation and this was considered the most appropriate solution. I also had nothing to lose except the $20 for late add, which is worth my peace of mind. Now I don't even have to wait for the EAD.
