So I been in the US for about 9 years, my stepdad is been a permanent resident for 30, married to my mom for 20, we have a pretty good record, I was well known in school cuz I was very active in the clubs, why cant I apply for a gc? my dad divorced his exwife in 1985 they both walked into the lawyers office sign all the documents, and finalize it right in there since it was a mutual agreement. they never saw each other again, This woman has not been able to give me any information, and i have a really strong feeling is because she doesnt care much. no returned calls, no emails, my step sister try to get the date and case number and nothing, so I been in touch with the LA recorders office and there is nothing honestly i dont even thing that there is a marriage showing up either and i t could be because my dad didnt have his green card then, I have poa on my dad, and Im also his SSB payee, I just finished all this process and the ex came up in his record but I just had the federal employee correct that on his ss.. now how do I help my dad to submit the 130s for us and do his CS, should i risk it and play dumb about that marriage? or should I write a really nice letter to USCIS along with the forms and explain the situation, perhaps I'll just dig my self in a bigger whole. If there is anyone out there with any sort of imformation that can help me finally start this process? all the layers wanna take the case, but the law is the law they just want money, when I talk to USCIS they dont help much eather... Thanks guys, i hope my email wasnt too long, I spent over an Hr and a half looking for a similar case but i couldnt find anything that is actually relatible to my case

I hope I have captured the key points and questions of this post. There are many un-answered questions that the OP has left out, so most of what anyone can stated will be speculations or assumptions.

  • So I have been in the US for about 9 years--How did you arrive in the US, was it legally and if so under what type of visa
  • my stepdad is a Permanent Resident for 30 years- if he is a PR, then your step dad had a CG at one time, does he still have a valid GC.
  • Married to my Mom for 20 years..... YOur MOM is the exwife ????
  • MY dad divorced his exwife in 1985, they walked into the lawyers office -sign all documents...never saw each other again
  • Dad didn't have his GC then - This is confusing, are you saying that they both were here illegal at that time
  • Have POA on dad, SSb payee - If you Dad is receiving SSB, then he is here legally now...correct
  • How to help Dad submit I-130 for US and do his GC - What is your age and your sister's age.. Dad doesn't have a GC?
  • Should I risk it and play dumb
  • All lawyers would not take the case...law is the law..they just want money
  • Spent time looking, couldn't find anything related to my case

Questions, what country do you'll have citizenship in? Do you and your sister have SS cards, are they under you'll legal and correct name. Can you'll obtain Birth papers? Did your Dad ever legally adopt you and your sister?

These are just some of the many questions that would need to be answered before any defintive directions could be given to you.

i got here legally, I am out of status, ok in order for my step dad to submit the i130, he needs to show that his last marriage was legally terminated. L A county says that a lot of those docuemnts from back in those days they are not in the "chip" they straight up told me that chances are that I am not gonna find it.. so if INS is asking for a document that i cant locate which is the divorce decree, what are my options, I am sorrry I made it so hard for you to understand, I been having a hard two years lol!! my daddy is been really sick

I am going to take a stab at this, you need to show that your stepfather was legally married to your mother, by showing that your stepfather got a divorce from his 1st wife. Is that what you are trying to say... ?

Again the question, what visa did you enter the US on?

Did your stepfather adjust your Mother's status? Is your mother here legally or is she out of status aswell?

How old are you?

You would have to be in status to adjust in country.

(I'm going to ignore the other issues going on here for the time being, and just answer questions about the divorce papers...)

I am pretty sure that just writing a "really nice letter" won't satisfy the need for any required documents. If you decide to risk it, you could receive an RFE for the missing documents asking you to send them in. If you don't send them, then your case will be denied and you will have to start over.

Maybe are you looking in the wrong place for the records? You said LA, but perhaps the divorce was finalized somewhere else, and after all this time your dad isn't remembering correctly. Where were they living at the time? What state was the woman from? Try looking in those places.
