Is there such a thing as a K1 for married couple?

Ok, My friend got married this past December here In Dominican Republic and her husband has petitioned her (I think) I´m very confuse about their process since they´re using a lawyer and don´t know either in detail what is going on, but according to them they are doing a K1 visa for couple married for less than 2 years which I find strange because I thought this was only for fiancee. Anyway can k1 be file for married couple also???

Marriage : 2003-10-03 (7 years of a Very happy marriage)

1ST Child : 2005-08-08 Timothy is born in NYC

2ND Child : 2009-06-29 Bianca is born in Sto.Dgo

Apptmt for Consular Birth report papers 2010-08-31

Passport and certificate received September 14, 2010

USCIS journey

Service Center : California Service Center

Consulate : Dominican Republic

I-130 Sent : 2010-04-15

I-130 NOA1 : 2010-04-18

Touched - April 27, 2010

Apprvd October 3, 2010 WHAT A GREAT ANNIVERSARY PRESENT !!!!!!

Visa appt 'February 7th 2011

NVC JOURNEY

K-1 is for engaged couples only.

Married couples file for CR-1.

You might be thinking of K-3. K-3 was for married couples and was just like a K-1, since they came into the US and needed to adjust status just like on the K-1 visa. CR-1s adjust during the visa process before they get into the US.

The K-3 visa though, is now obsolete.

Yes , K-3. U.S citizen can file K-3 for foreign spouse to come to usa and adjust status to become PR. But now a days they have issued a notice that I-130 approvals are also taking same time that K-3 petitions takes. So if they will find that both petitions are approved togather, they will cancel the K-3 petition and will continue with I-130.

06-06-2021 - Recevied NVC case no. - case entered into nvc's system

06-08-2021 - IV fee
07-05-2021 - IV & AOS documents submitted online

07-19-2021 - received message from NVC about case can not be processed unless all civil documents are submitted (was missing police clearance)

08-12-2021 - submitted police clearance certificate - which was last document submitted to NVC

11-05-2021 - Case completed at NVC - DQ

03-31-2022 - Interview letter received

04-28-2022 - Interview date at mumbai embassy

That´s what I keep telling them that they file a k3 which no longer serves its purpose which means that they also file a cr1 and since they let the lawyer take care of all of this they have no idea what´s going on, they think that they will be filing for cr1 once they´re in the states. I hope that by the interview date they know what they are in for.

Some lawyers like to charge the extra fee to file the second petition. Some simply don't keep up with the changes in procedure.

Facts are cheap...knowing how to use them is precious...
