Hi Everyone,

I want to share with you this news from the Lagos Consulate with all fellow members going through this consulate.

This is the response i received from my email i sent to them..................

However, the spouse visa petitioner (I-130) does require evidence that the petitioner to earn above 125% of the poverty line. If the petitioner of the I-130 is unable to show that they alone can sponsor the applicant at this level, then a cosponsor is required (and accepted). We hope this informationp proves helpful. I am requesting some information on the fiancee and spousal visas that come through your consulate.

I am yet to file a petition, so i have no case number as of yet. I do however have a question about the visas i have listed previously.

My question is this...does your consulate accept co-sponsors on the fiancee visa and or the spousal visa?

I need to know this because I will need to provide a co-sponsor (to meet the 2006 income guidelines of 125% above poverty level) when I file either the fiancee or spousal visa.

Please, any information you can provide to me on this issue will be much appreciated. Thanks in advance.

That's interesting! I wonder why they referred to it as expedited fiance visa petition, though?

WOW!

Hmm, is this only a specific consulate (Lagos) situation??

If this were the case, I'd be ecstatic. I'm just graduating college and will have a sufficient job to support my fiance in no time, but I don't have that job as of yet. If the I-134 wasn't necessary for this K1 process, I could rest alittle easier.

Any thoughts on this??

- March 7th 2006: Dan and Xuejing (Allie) met on a train going from Shanghai to Beijing

- Spring 2006: Have an amazing relationship that goes from friends to more than friends

- May 2006 to June 12: Live together in Chengdu, China and talk about our future, MARRIAGE!

- June 12 2006: return to Beijing for a week; the place it all started.

- June 20 2006: Dan returns to Milwaukee, WI.

- June 20 2006 - Begin to prepare K1 materials

- September 5, 2006 - Sent I-129F

- September 6, 2006 - I-129F Received

- September 14, 2006 - NOA1

- September 17, 2006 - Touched

- November 17, 2006 - Touched

- November 18, 2006 - NOA2

If this were the case, I'd be ecstatic. I'm just graduating college and will have a sufficient job to support my fiance in no time, but I don't have that job as of yet. If the I-134 wasn't necessary for this K1 process, I could rest alittle easier.

My thought is that I'm going to e-mail the French consulate right now. :) And don't get your hopes up just yet. E-mail your fiance(e)'s consulate, maybe?

Edit: French consulate doesn't accept e-mails, dangit. Hmm.

I think it's odd to call it "expedite". You can file for an expedite request with USCIS, not consulates, as far as I know.

From the USCIS site:

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Service Center Director. The criteria are as follows:

* Severe financial loss to company or individual.

* Extreme emergent situation.

* Humanitarian situation.

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States.

* Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government.)

* USCIS error.

* Compelling interest of USCIS.

If a response to the expedite request is not received within 72 hours, the request is denied. The application or petition will then undergo normal processing

Also, I may be mistaken, but I remember reading that Lagos is very "picky" in they way they handle interviews to avoid scams (not that it's the case of the OP's fiance, let me be clear).

Yes it is consulate specific. The majority of consulates use the I-134 in part to assist in determining if the applicant will or wont become a public charge. It is not legally binding and there are different requirements then with the I-864 which IS used to show financial support.
