Hi All,

I am preparing the packet for I-130 filing for my husband. In the I-130 instructions hasn't mentioned about I-1864, Affidavit of Support when to send or with what to send?

Can someone please let me know if we have to include I-864, Affidavit of Support (filled)form along with I-130 Form along with G-G325A (Petitioner and Beneficiary) with additional supporting docs?

Do we have to include I-864 document also along with I-130 petition packet?

Appreciate response asap.

yep! i130, i485, G325A, i864, i765,i693 (medical and vaccination form) and I believe 2 passport photos, plus all the documents, and proof of a bona fide marriage.

I am not clear about i765- what is this form used for?

I693 (medical and vaccination form) - from what i understand reading all the information in the forums, it is sent by VSC to beneficiary.

Please correct me if I am wrong.

The previous answer was given for an adjustment of status case, not a visa case. If filing the I-130 to begin a spouse visa case, you do not send an I-864. It comes later after the petition is approved. If this is a visa case, simply disregard the previous response.

you were asking about the adjustment packet, that is only if your husband will be adjusting in the US. If he will be going through consular processing, the only form you need for now is the i130.

where is he going to adjust, in country or consular processing, you didn't say. If it's consular processing, you don't need the G325A, only the i130. Consular processing is different from in country AOS.

when your I-130 get approved, your case will be send to NVC.

you will need to file AOS package(I-864) and IV package(DS-230) at NVC stage.

This is incorrect. Please note this is posted in the CR1 forum, indicating the pursuit of an immigrant spouse visa. No "adjustment" of status is needed but a G325a is definitely needed when filing an I-130 for a spouse REGARDLESS of whether for a visa or to adjust status.

Please carefully study the I-130 instructions before persisting with this incorrect advise.
