the sponsor must domiciled in the US??..

Me and my wife live and work in the UK.. my wife is a USC.. my wife only has limited leave to remain in the UK and we are planning to move back to the US. My wifes previous address was with her parents in the US and they have said that we can move in with them. Will this satisfy this ??

Don't know. Only the consular officer who is processing the visa application will know for sure.

Recognize that being domiciled with relatives can have implications for the I-864.

Lquin,

I can help you with this a bit. My wife ad I are in the same situation, she is the USC and lives here in the UK with me. She applied for my IR-1 visa for me and we got it last November. As far as I am aware, domicile means that the USC has to still have a residence in the US. If your wife's name is still on the house she lived at in the US, then I think this is ok, perhaps someone else can confirm this for me.

However, I would warn you, if your wife has been living here for some time and hasn't earned any US income, then she may not meet the requirements as a sponsor. Although you can also have your income and assets included, I believe this has to be 5 times the current poverty guidelines for the size of your household(in this case I guess it is just the two of you). We applied for my visa with just my wife as the sponsor and when I went to the interview, the consular officer said that because my wife wasn’t earning any US income at the moment, she couldn't be used as a sponsor. Also, my assets didn't meet the criteria either. Luckily, we asked my wife's Mom to act as a co-sponsor and we took along her paperwork just in case. The officer accepted this as she met the guidelines based on household size and income. So, I got the visa. What I am saying here you may want to check all this out and find a co-sponsor who currently lives in the US, just in case!

You should be ok. I live in Canada with my husband (I'm the USC; we're awaiting case completion) and we're staying with friends when we first move back to the US. We're going to draw up a "lease" with them showing we have a place to stay and we have also already opened a joint US banking account with a US address. I've read many times that what they'll basically look for at the interview is any ties your spouse has to the US.
