I am USC about to petition for 20yr old illegitimate son (unmarried) who will turn 21 on JAN 2011. Will he qualify under CSPA? Lawyer I am talking to said she wants $2000 for initial consultaion and petition to the USCIS and additional $1500 at NVC stage of petition. Don't mind paying the money but she won't tell even tell me if he qualifies under CSPA. She asking me to provide a LOT more documentation than what USCIS website is saying.

Anybody out there in a similar situation? What was outcome of case? I learned about this website through a friend who petitioned fiancee and in 6mos. she arrived. I stay up late at night thinking and doing research on what I need to do. Thank you for reading my post!!!

You might want to speak to some other lawyers who are well versed in this kind of thing. Its not always best to go with the first lawyer especially if they wont even explain things to you or give you information on your specific questions.

What evidence do you about presumably paternity.

Usually it should not be an issue.

do you have a relationship with your son? they might request a paternity test. you don't need to pay that much just to fill out an i130 you can do that yourself. the form is only $355, so the rest is for her, too expensive for an initial consultation.

Hey Boiler, My son is in the Philippines. When I was in the USAF, I enrolled him in DEERS (claimed him as dependent) Just signed statement of paternity. I realize its different with the USCIS so I just wanted to know what other documents can I use to establish paternity. Someone said paternity/dna test which is ok too but not sure how that would work since im in u.s. hes in philippines :(

If your name is listed as his father in his birth certificate then file the I130 now(will be under immediate relative), while he's under 21.You don't need an attorney by just filing an I130.file now and just think of the next step.....

Hey Cucumber, thanks for reply. unfortunately im not listed as the father in his birth certificate since we were unmarried/minors when he was born and they had a family code (not sure if its still the case now) that said child should carry mothers name

do you know what else i need to send with the I130? Since i dont have my name on his BC?
