OK, I will be one of the brutally honest posters here and in need of some assistance. I met my fiance through a friend who has a russian wife that lives in the US. She already had a tourist Visa to come and visit her friend. We have talked a few times on skype before she came and now has been in the US 2 months on a tourist visa that is good until December 2010. We had NO INTENT to marry when she arrived! We have spent all of our time together getting to know each other since she has been here and we do want to get married. A couple of questions,

I would like her to stay but she needs to back and get the rest of her belongings. If she comes back again on the same tourist Visa can we get married after about 3 months and file for her AOS here?

Second, if that is not advisable, should I marry her here and file for a K3 and if so would she be able to return during the K3 process on her tourist Visa?

If she goes back to Russia and then comes back on the tourist visa, that could be a problem since she would now intend to become your spouse and adjust status.

You can marry her now, apply for AOS and advance parole. With the advance parole, she can return to her country and come back without any problems.

K3 is a safe option, but it can take longer than AOS to get her greencard.

If she goes back to Russia and then comes back on the tourist visa, that could be a problem since she would now intend to become your spouse and adjust status.

If you marry now and file for AOS, she won't be able to leave until her AP is approved.

Other option--

1) Since the K-3 is practically dead, you should be reading up on the CR-1 instead.

2) You can file for the CR-1 while she's still there, let her return to Russia and sort out her stuff there, and then arrive with a CR-1 after her visa approval.

3) If she can show strong ties to Russia then she can come visit you during the CR-1 process on her tourist visa.

if you're dead set on this one, buddy, marry her now and apply for AOS/AP/EAD (about a thousand bux). she will get the AP within 2-3 months and then you two can travel to her home to get "married" there and clean things up. this is the cheapest/fastest/easiest/safest option.

or, you could get off the roller coaster and take a year or so to figure out who you are.

Old fiancee left you on feb 23rd and since then you met this one and want to marry too? Maybe let her go back, go to Russia to see her a couple of times, spend some time on this relationship and see if you want to file a petition for this fiancee or marry her and file for a CR1. Maybe just slow down a bit to see if the chemistry is there.

Make sure to take tons of pictues while she's here.
