Hi all,

Many may know about my case and I am looking for some more information because I am a little confused with my marital status. I came to the States with a K-1 visa, married but I haven't change my information in my birth country (Thailand) so I guess this means I have never been married according to Thailand. My marriage was terminated in the states in November 2008 by the court.

In the future (after my currently pending case AOS (i751/adjust of status) is decided and planning/anticipating a negative decision), my USC fiance and I plan to file a K-1 visa IMMEDIATELY after receipt of the decision, the questions I have are the following:

1. Will my marital status on I-129F, G325A be "divorced"? (Sounds right because this is as seen by USA not Thai?)

2. Also I'm guessing that my marital status would be "divorced" on my DS-156, DS-156K ( the documents that I need to fill to the American Consult in Thailand)? Even though I wasn't married or divorced in Thailand but only in the USA.

Whether a person is married or divorced is not country specific. You married, then divorced, therefore you are divorced.

@Southlake - If you do get the K-1 Visa and marry again, you should send the Marriage Certificate to the appropriate Thai Consulate/Embassy to register your marriage in Thailand. You are still married, but it is recommended that you inform them. You can do a search in Google to locate the Embassy or Consulate to use for the US State you live in.

@Audy_Rob Thank you for your suggestion here. We live just only 25 minutes from DC, then it will be easy for us to go there.

Anyway, I still have some thing on my mind, it is:

Do I need to bring my American divorce certificate ( issued by Baltimore court, Maryland) to get notarized at the American consult in Bangkok? (Someone told me about that but she had Norwegian divorced certificate) ... Mine is an official copy from the court signed and with an embossed seal/sticker on it.

No, you have a certified version which is all you need for now. Submit copies of the divorce decree with the NEW I-129F petition. DO NOT send the version with the seal on it as that is your ORIGINAL.

Also, for the interview at the US Embassy in Bangkok, you will have submitted the copy again when you return Packet 3. But you need to take the ORIGINAL to interview.

Correct. The OP needs to bear in mind that no agency of the Thai government is involved in any way with your divorce or US immigration process except to provide a current police report at your request. You need not register your US divorce or Marriage with the Thai government. You CAN but it is not a requirement of the US immigration process or to have your marriage recognized.
