I-485 Medical

Ok, finally got our RFE...USCIS is requesting an I-693. This contradicts the instructions for an I-485 since they took this form when I came across the border in Vancouver back in Janurary (exam was in Dec 05) with my K-1 visa. Has this happen to anyone else and what was the resolution? (I did submit an I-693A on the correct form).

Help! I’m on the phone with them and they don’t seem to get the message about their own rules.

strange. I did not have that problem. I submitted the I-693A supplement and they have scheduled our interview. a K1 does not need to do another medical, that is very clear on the instructions

We had the same problem with our K2 and received a RFE for a new medical and I-693A vaccination supplement. As it was less than one year since he had his medical and we had already sent in the I-693A, I phoned USCIS to check and was told that whilst it is not technically necessary according to the written rules, each service center has every right to ask for anything they want, and if you don't send it you will be denied.

Needless to say we got it done and were approved, but there have been at least two occasions this year on VJ where people didn't get it done because they followed the written rules, without realizing that each service center has the authority to ask for these again, and were denied. (sorry can't find the links - maybe someone else can post them.

Probably better to just comply than risk being denied.

Copy, I have seen the same thing, but there has been at least tens in the last month and have seen no problems occur with transfers to the CSC. Strange.

I think it must be something more specific to CSC as that's where ours came from too!

Try to submit a copy because they obviously don't know what "their" forms contain.

In addition, try to speak with an immigration officer, who knows a little more info than the cust. rep. or schedule an infopass appt

I agree with Perfect:

Even though the guidelines are clear and according to their rules you DEFINITELY should not have to get another medical, there have been several cases here where people were denied because they did not fulfil the demands of their RFE and didn't get a new medical.......

So what do you prefer: Fight with them for your rights, be denied and have to go through all the hassle of having the case reopened etc......or go and have the medical again, pay the fee, hand it in and probably be approved after two weeks, thus having the green card in your hands in just a few weeks?
