Good Evening All,

I am helping a friend from the Philippines. She was married in 2002 and after a year the husband left her. She had no contact with since then.

In 2008 she met a guy ( American) and fall in love and they file presumption of death as advise by a lawyer. It has been 14 months and they are still waiting for the court decree. She was told that the judge is still not around to give the decision. Anyway, my question is to those who had file a case like this, how long does it take to have the decree ?

A declaration of presumptive death of an absentee spouse is now viewed with suspicion by the US Embassy. Once the embassy conducts a background check and finds the absentee spouse alive, this could result in a finding of fraud and misrepresentation. As long as your friend truly believes that her husband is truly deceased, she should be okay with presumptive death, if not, then she is taking a risk.

About your question, court decisions can take anywhere from a few months to a few years, depending on the judge and the circumstances of the case.

June 25, 2018: USCIS Scheduled an Interview
Aug. 02, 2018: Interview Date- APPROVED!
Aug. 09, 2018: Oath Ceremony

hello,i had filed the same case 3 yrs ago and it took 5 months to have the court decision.and now we are waiting for our noa2,i had a friend that filed the same case{presumption of death} and they are all in the states now.heres my ym id if she wants to talk.silknsatins292006@yahoo god bless
