Hi, I am trying to figure out what the best option for my situation would be. I am the USC, living in Nicaragua and getting married to a Nicaraguan. We will probably continue to live in Nicaragua for a while longer, though eventually (maybe in a couple years) we would move to the US.

I came across the Direct Consular Filing because it is for USCs residing abroad. However, we won't be moving to the US right away to establish residence, so I am thinking maybe this is not the option for us (at least not yet); is that right? But I do want to be able to bring my husband into the US for family visits, Christmas, etc.

Do people here know if there is any type of temporary visas for someone married to a USC? He could always apply for the tourist/visitor visa - and maybe that is the only option. But I wondered if there was anything more specifically applicable for our situation... or maybe if there is special consideration on a tourist visa if the applicant is married to a USC?

Sounds like a good case for a K-3 but they're administratively closing them at NVC now.

Maybe contact NVC and see if there is a way to complete a K-3 as that would allow her multiple entries and I believe they're valid for a couple of years. If you can then you could move to the US before the K-3 expires and file for her to Adjust Status.

Thanks for the responses. I'll check more into the K-3, but looks like the tourist visa may be all we can do until we get ready to move back to the US. We'll ask at the Embassy here in Nicaragua.

I am wondering the same thing. I married a Vietnamese and we will eventually apply for the I-130 (DCF), but we just want to live in Vietnam for now and just visit the USA. We have already applied for her tourist visa once, she went to the interview, and they denied her! They said her job does not pay well enough. They are mainly looking for PROOF that she WILL come back to Vietnam and not immigrate to/live in the USA illegally. This time, we will give supporting documents from BOTH of our employers and show my renewed labor contracts and hopefully that will be enough. Oh yeah, the visa officer also wanted to see my passport, but my wife didn't have with her during her interview. Here it costs $131 USD just to apply for the tourist visa!

This situation was similar to ours when we started the K3 process a couple years back. I wanted my wife to visit the U.S. while still being able to work/live with her in Cambodia.

We filed both 129f/130 together at the time and delayed the 130 process until we were both ready to move to U.S. Her K3 was approved quickly and in fact she just had her IR1 interview today and approved. So the next time we enter the U.S. she will have a 10 year greencard and social security card mailed to us.

All this time, we enjoyed the benefits of the two year K3 multiple entry. And now we are taking advantage of the IR1 for ten year greencard.

You purpose is exactly within the definition of a B2 Visa.

The special consideration is that it may be harder to get.
