please confirm to me my fellow pinays who done their annulment b4...

COURT DECISION + CERTIFICATE OF FINALITY= GOOD TO GO ON RE-FILING OUR K1????? :blush::unsure::blush::unsure:

not too fast there.... you have to wait for the Decree of Annulment!

i agree u need to get the DECREE b4 u start filing cos u will have to attach it when u send them the 129 packet :thumbs:

I think so.

Actually, the court's Final Decision is enough to go with your K1 initial filing. You only need to be ready with annotated MC, clearance or cert of no marriage during the actual interview. With that being accomplished early on, you can NOW start counting the days till your get your appointment for interview.

I filed for my wife's K1 with just a copy of the court order successfully.

It is a risk since the requirement from USCIS is that the beneficiary must be free to marry, and until you obtain the certificate you are not technically free to marry.

However, USCIS does not know the laws of every country to check , this is done by each embassy.

So, it is very likely that USCIS will accept the court order, but at the embassy you will need the decree and the certificate.

If I had to do it all over again I would do the same.

Just be sure that you WILL HAVE the certificate on hand for the interview, and that will be few months after the court order.

In my case we probably save 3 months.

tnx luningning and krizzie for the reply, mhuaaa!!! but i think we will re-file at once when i got my cert. of finality and court decision... to save time... :P;)

and even my atty. she told me that i can re-file too, maybe she had clients b4 who did this... :blush: :blush: :blush:
