Just when you think you are awaiting your packet 3 and interview you chase your application and receive this email:

U.S. Citizenship and Immigration Services (USCIS) is unable to locate your petition or application. You are requested to file a duplicate petition or application in order to reconstruct your case. In the interim, USCIS will continue to search for your approved petition, but at this time it appears that your petition has been lost.

Wow!! that sucks.

So do they expect you to file all over again and pay $455?That is completely unfair and such a bad blow.

Hopefully,they recover your 'lost' petition.Could you may be contact your senator or congressman?Just give it a shot.

Oh my gosh, how terrible!! I hope they don't expect you to go through the WHOLE process again, just to send them the paperwork over and you will automatically be moved on to embassy stage. That sucks!!!

Timeline

Since you received your NOA2 according to your timeline, did you call NVC to see where it is? Once USCIS approves it it goes off to NVC. Call them, speak to a live person and don't hang up until they find it

Don't file a duplicate petition until you get this straightened out

NVC never received the file. I was chasing for a long time and just receiving the same old it can take 60-90 days from NVC.

I even emailed NVC with a copy of my approved NOA2 and they never responded.

We then finally got in touch with someone at USCIS (after we had been in touch several times, done a service request and had no infopass appointments in our area) who told us to wait 60 days so we did. Finally after waiting the 60 days we got in touch with a supervisor at USCIS and then managed to elevate the call to their boss who gave themselves 72 hours to investigate the matter. The final thing we heard was the email I posted. We have to resubmit if they are actually admitting to losing the case and there is no extra charge to do it and hopefully it is going to be expedited.

Make sure you write URGENT -- EXPEDITE DUE TO USCIS ERROR on top of your cover letter when you re-file.

I guess I don't understand the reasoning behind the advice NOT to do precisely as the email states they should do. Maybe you can explain it to me? I mean, they got to a supervisor who has now apparently told them how to fix it.

OP, in this email, did they give specific instructions for any Attention: or special address for this duplicate packet?? If not, I would try to email back to get that info, or get your congressperson/senator involved to make sure that THIS time it doesn't get lost.

Then, here is what I would do -

I would reconstruct the entire I-129f packet I mean, if you followed the guides here, you have a complete copy of the thing anyway. Just get some fresh signatures on there. Then, I would also create a "cover packet" which would include the following:

- Cover letter stating the situation, case number, and your instructions. Request waiver of fee and expedite due to USCIS error. Reference the remaining things in the "cover packet"

- Email with the instructions to send duplicate & admitting it's lost

- Photocopy of NOA1

- Photocopy of NOA2

What a headache! Hope it gets straightened out soon.

Oooh, I just noticed that you got a military expedite. Maybe there are some other resources available from the same source to help you sort this out? I'd try there as well..

It doesn't sound to me like they are asking for another fee. They want paperwork to reconstruct the file. All K-1 filers should make a copy of their petition paperwork prior to sending it ... just in case something like this happens.

Hopefully you have a spare copy you can photocopy to send them, and an address to send it to.

I did make a copy but we had to update most of the forms so original signatures could be done and also reprint the pictures including getting up to date passport photos.

We now have an address and named employee at Vermont office to send the application to so fingers crossed it all gets sorted asap

Same thing just happened to us. We had the AOS interview (from a K3), they lost the medical exam, we submitted another medical and heard nothing back. We filed a service request to find out what is going on and we get the same letter you did, that they have no record of our application/petition! How can that get lost in the system when we have gone so far as the AOS interview??
