Withdraw K-1 Visa Procedures

Timeline

My relative is going through a alot with the breakup. I stepped up and trying to help him with legal issues. I would appreciate for any guidance i can get from any of you. Well his I-129F has been approved and the visa is issued.

My question is: what procedures should I take to cancel/withdraw this K1 Visa?

If the visa has been issued, that part of the immigration process is complete. The beneficiary can either use the visa or not but if there is no marriage to the petitioner, the beneficiary has no path to US legal residency.

Timeline

If the beneficiary has not entered the USA no action needs to be taken. If no entry occurs within 6 months of the visa issuance, the visa merely expires.

Also, if the beneficiary enters the USA and the marriage does not occur, the I-94 ends at the 90 day mark. If the petitioner leaves the USA prior to the 90 day mark no action/notification needs to occur. If the petitoner overstays the visa thge petitioner should notify USCIS.

Petitioner is the US Citizen. All above is correct if you replace the word "petitioner" with "beneficiary" or "visa holder".

Thanks for your responses. Let me little bit elobarate on my relative particular situation. The situation is a little bit more complicated. He is unable to reach his fiance after she received the visa. There are good chances that it's a fraudulent case. So he is unsure if she already arrived to U.S on the fiance visa. What if she already arrived to U.S, is there any way to find out if the visa has been used?

How can i save him from any future legal troubles? I mean if he is unable to locate her and she starts to live here illegally, would he go through any legal troubles? Would he still be able to sponsor anybody else in the future?

Any assistance and help will be very appreciated. Thanks.

Have him call ICE Toll free: 1-866-DHS-2-ICE.

He's not responsible but it may make it more difficult the next time around.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Here is my situation... I am from the US and my fiancee is from the pakistan,Our K1 visa was approved in March 17 unfortunately things didn't work out between the 2 of us,. I lost in touch with her after she received her visa. Apparently the number I used to reach her is switched off. After all my best efforts I failed to reach her,than i contact with my friend,he working for airlines,he told me She has travelled to US on 04 April 2010 enter to usa newyork without telling me,i aready send my withdraw letter to the U.S. Embassy Islamabad pakistan,but i really need help here ,thankyou

You absolutely have to call ICE (number at the bottom of the page) and report her. She is not allowed to be here after 90 days, and the only way she can adjust her status is if she marries you.

Just to clarify, since the visa has already been used, it cannot be revoked or cancelled. It's a single entry visa that is dead upon US entry. Calling ICE (Immigration and Customs Enforcement) is probably a good idea, to protect yourself and potentially your fellow citizens.

Definitely call ICE. You can't revoke the visa beyond this point but you can inform them that she entered the US with no intentions on marrying you.

I noticed that too - it says visa Green Card was issued over a year ago and POE was in 2008.

See profile for our K-1 Visa/AOS story from 2010-2011Apparently we love USCIS/NVC so much we left and are doing it again! This time giving IR-1 a whirl. Rock on immigrators.

07/17/2014 check cashed by USCIS

10/01/2014 found out we are expecting baby #2 June 2015!

12/30/2014 Case received by NVC

03/23/2015 Received Case and Inv # from NVC after many calls and bogus excuses.

03/24/2015 AOS payment accepted by NVC

04/09/2015 IV payment finally accepted by NVC after the set the wrong fee and took weeks to correct it.

*many more delays thanks to the agency processing my fingers prints to the RCMP and the post office losing our mail*

05/20/2015 Packet sent to NVC via UPS, eta May 28.
