Waiting for last document to file AOS

Well I have been waiting two weeks now to get the W-2s from the IRS for 2004 so I can file the AOS. Since I didn't file taxes for 2004 I have to wait for the W-2's to come and figure AGI for that year, get a letter from my tax agent and then I can send it all out! How crappy is that! Well I guess it's my fault! But I didn't know I would be marrying anytime soon and I figured I had at least another year til I filed for 2004. But I guess God had another plan. So now I am sitting here waiting for the mailman to drop off any mail to see if it comes today. Hopefully it will come by next Wednesday. I am getting tired of having everything ready to be sent to Chicago and not being able to send it! Oh well I'm sure it will all be fine! Hope everyone is doing well with their petitions and visas. Have you taken a look at the latest I-864 or I-864EZ filing requirements? - only latest tax returns were required for filing.

They say you can submit more if it helps to prove your case, whatever that is supposed to mean.

I have read the requirements, and I have also spoken to about 4 different people from USCIS about this. I still have to have filed for the past 3 years. I have only filed for 2003 and 2005. So I have to wait until my W-2's come so I can start the file and send in the letter stating that I am filing. Don't really understand why they require 3 years, but that's what they told me to do. Plus, they never seem to factor in the fact that even if you are above the required poverty line that after your spouse/fiance gets their EAD, you will have more money coming in the household. Go figure.

Yes, you are right... Close to the end of section discussing federal taxes they mention that you need to submit 3 years if you failed to file.

I think that the USCIS needs to work on consistency because when I called them back in June they told me that I only needed last years tax return and that if I wanted to include others I could but I only needed the one. It also said in the instructions of the newest I-864 form that you only need the latest tax return. I guess they need some better training on what they are telling people. I only sent one and I am not worried about it. Unless you really feel uncertain about it I would just send it like you have it.

You only need to send the latest tax return on paper. But you need to have filed the past three years. That's where I screwed myself over. So now I have to wait so I can send it

OHHHHH. So did they make you file now or how did they handle that. I am curious. That really does suck! I hope your wait isn't too long. Hopefully the IRS is faster than USCIS
