Hi,

My wife and I want to petition her 2 kids in the Philippines, I was laid off before and we decided to wait to petition them later, but now have a very good job. She has been here over a year now. I do not think they can still follow to join? So we have to petetion with the I-130 again? How much is it per child and how long does it take now,she is a green card holder, and im not the real father. So the best way to go is for her to petition as a permanent resident?

Thanks for any info:-)

What do you mean I-130 again?

A CR-1 visa does not have derivative follow to join

How old are the kids? If the parent/stepparent relationship between you and the children was created after the children were 18 you (the stepparent USC) cannot petition for them.

YMMV

You as the USC need to file an I-130 for each and attach the documents to both petitions, marriage certificate, birth certificates of the child etc. They will have there own stand alone I-130 but shulod process at the same time. I ( USC ) did this for hubbys kids in 2007, filed May 2007 kids were in the US by March 2008. see my story.

Why is it that the only one who can stop the crying is the one who started it in the first place?

There is no again, as they ALWAYS needed there own separate I-130.... simply being named on your wife's I-130 was not enough to get them an immigrant visa at any time.

YMMV
