My fiancee had an abortion in 2004. I meet her in late 2004. We are engaged. I knew about the abortion before we were engaged. She is now preparing for the interview and already had her medical at St Lukes. Will the USCIS have an issue with my Fiancee having had an abortion before? This is bothering us both and we need to know if this is cause for her to be denied. I am not a troll, so please give advice.

I bet it never comes up...you are probably worrying about nothing. I dont think that would be a reason for her to ever get denied a visa. I wouldnt disclose it unless asked about it (it's really none of their business)...then of course tell the truth about the circumstances.

First of all she doesnt have to declare that she had an abortion. thats intensly private and frankly none of their business. She can simply say she was in hospital/had an operation for gynae reasons. They wont ask any more. There was nothing illegal and you both shouldnt worry. Its not up to the consular officer to make a moral judgement call anyway. They are concerned with 3 main things; a) that your relationship is genuine b) that there is nothing criminal in your past and c) that there are no infections , sexual or otherwise that may prevent you from being admitted.

They dont check medical records. the medical is just to determine whether the applicant has disease or alcohol/drug issues. there is no reason to ever have to declare an abortion. They wont ask about it. It would be wrong of them to do so.

So what happened during her medical? Did she pass? Abortion is illegal in Philippines any woman who undergoes abortion and get caught will be in imprisoned and also any person who assists the procedure.

Welcome to VJ. Try to relax.

Abortion is not a reason for denial for a k-1 visa (assuming that abortion is not illegal in your fiancee's country).

Typically the Consulate is only concerned that you have a bonafied relationship with your fiancee and an abortion that occurred 6 years ago is irrelevant to your relationship.

As long as you proove ongoing relationship you'll meet the criteria for issuing the visa (plus of course the financial issues of the I-134)...

hmm didnt realize it was illegal since 1930 to get an abortion in the PI. I would follow what wildewood said.

My Fiancee already passed the medical with flying colors. I am assuming from the relies that even at the adjustment of status that there should be no issues in regards to her abortion. I myself, also believe that the decision to have an abortion is also a private issue, and frankly is non of ISCIS's business. I actually JUST checked and neither my fiancee nor myself was aware that abortions in the Philippines is indeed illegal, except for when the mother's life is in danger. As I mentioned, this was six years ago. My Fiancee could not believe what she did then was an illegal act. I will not discuss specifics about my Fiancee's postion in regards to this. I am open to hearing others opinions on this subject. Thank you thus far for the replies, it really means a lot to both of us.

In medical, the docotr do asked if the female patient had been pregnant before. If she said yes, then the next question would be: what happened to the baby. If she said that she aborted the baby, there is high probability that she has to undergo psychological exam.

To the OP... it is a well known fact tha abortion is illegal in the philippines. People both from manila and different provinces know this. There is no doctor that would legally abort the baby of a healthy woman. Most of those people doing abortion are illegal and not licensed to it. And the Catholic, Protestant, and other Christian churches preach that abortion is a sin.

It is very strange that your fiance does not know that abortion is illegal.

I apologize that you find it "strange" my Fiancee did not know about it being illegal in the Philippines to have an abortion. This was a home remedy type, not doctor performed. My Fiancee is not up on the laws where she lives. Actually as far as it being "well known" that abortion is illegal in the Philippines, several of the posters thus far were not aware of the legality of abortion in the Philippines. Many of us do not know the laws of different countries. I'm not making excuses of any kind, and I am not justifying anything here. Just being honest to the contents of my post, and asking for some advice. What's done has already been done. It has been a big issue in my Fiancee's life in her decision earlier in her life. She regrets her earlier decision, but it's too late to change that event. My Fiancee had actually told St Luke's that she had a miscarriage. That ended the pregnancy question. We all live and learn in life at different levels and with different issues. Thanks for posting.

Of the previous posters only 2 have the non-USC SO from the Philippines and the poster who didn't know that it is illegal is most likely the USC Husband (Scott).

I just asked my wife what she thought of this and the look on her face was priceless as she said "Why wouldn't she admit it, Philippines Laws are written to Catholic beliefs which is why there is no Divorce AND abortion is illegal. Anyone who says they don't know isn't being truthful about that."

I trust you are aware of the differences between Eastern & Western definitions of honesty?

Please don't misunderstand the point of my comments, I'm not passing judgement just commenting...

Abortion is a crime of moral turpitude in the philippines. She is best to keep quiet and never bring it up until she is out of there

I think your fiancee gave them the best answer. If there was no surgery for the abortion, then how would they know if it was a miscarriage or an abortion?

Yes I am the USC and I had no idea, but it does make sense with the catholic beliefs. There is no need to go into details on it and I know I'm not judging. I dont think there will be another question on it throughout your process. It is documented by St. Lukes that she had a miscarriage.....end of story.

but i am curious too, if a woman had an abortion many yrs. ago will an O.B dr. can detect if the woman had a miscarriage before..? what i know is that there is a dr. on SLEC that really will check on this one.. if u delivered a baby b4... uhmmm for me to the OP yes just to make safe dont tell a lie to SLEC, like rheanick said ur fiancee will probably under-go a psychological evalution if she didnt pass on the evaluation the SLEC dr. will recommend her to take psych test but if she passed then no more psych test...
