Hello,

My fiance had her Visa interview 2 days ago at the Manila Embassy for her K-1 Visa. The Visa was approved but then given a temporary refusal saying that they needed to see more Evidence of Sustained Income.

I sent my recent Tax Return, Bank Statements, I-134 affidavit of support, Letter from the bank with my current balance, as well as a Self-Employment letter. And I also had a Co-Sponsor, my mother, who sent an I-134 as well and she has plenty of income to support us if needed. But unfortunately the officer didn't accept my mother's Co-Sponsorship :( I am a Independent Contractor working as a Freelance Filmmaker so i don't have an employer and a constant paycheck...i just take whatever job i can get. And most of the time my jobs go unreported to the IRS, so unfortunately my tax return only showed an income of $10,000 after my deductions. But my bank statements and deposit records showed that i deposited almost $40,000 last year. Twice the amount of the poverty level.

Does anyone have any suggestions of how else i can prove that i can support my fiance? I was going to send copies of my Apartment Lease and rent checks and utility bills...a copy of my cars Pink Slip...Copies of my camera equipment that i own totaling $14,000.

Any other ideas or suggestions? Is there anyway that they will accept my mother as a Co-Sponsor?

You shot yourself in the foot by not reporting all your income. If you had, your tax return would have shown enough income to qualify. Everything you're doing now testifies that you cheat on your taxes. Consular officers, who are government employees, tend to take a very dim view of such behavior and start wondering just what else about your documents is false. Good luck.

You shot yourself in the foot by not reporting all your income. If you had, your tax return would have shown enough income to qualify. Everything you're doing now testifies that you cheat on your taxes. Consular officers, who are government employees, tend to take a very dim view of such behavior and start wondering just what else about your documents is false. Good luck.

Well legally i didn't have to report my income and neither did the people hiring me...If you don't make over $600 in 1 year from someone who employs you, they don't have to report the income. And me being an Independent Contractor, I worked many different jobs throughout the year for different people. Only the people that i made $600 or more from reported my income. I work a lot of 1 day jobs for anything between $100/day and $650/day depending on the job.

I was thinking about flying to the Embassy in Manila and meeting my fiance there and i would plead my case and provide them with the other documents i stated in my original post. Any thoughts?

Well legally i didn't have to report my income and neither did the people hiring me...If you don't make over $600 in 1 year from someone who employs you, they don't have to report the income. And me being an Independent Contractor, I worked many different jobs throughout the year for different people. Only the people that i made $600 or more from reported my income. I work a lot of 1 day jobs for anything between $100/day and $650/day depending on the job.

I was thinking about flying to the Embassy in Manila and meeting my fiance there and i would plead my case and provide them with the other documents i stated in my original post. Any thoughts?

You are wrong, you are an indepedent contractor, by law you are required to report all income earned to I.R.S. If you try to make this same case to the I.R.S, you would lose.

The companies that employed you may not be required to report your earnings for tax purpose, but you are required to report and pay taxes on all incomed earned over a certain dollar amount. Those companies should have issued you a 1099 showing income that was paid out to you, they do not have deduct federal or states states, that would have been your responsibility. Any accounant will tell you the same thing, the consular office may require you to adjust your income taxe papers to reflect the correct amount if you want then to use those numbers. Think about this, and what this may mean to you.

Just because your earnings from a particular job aren't high enough to require that employer to file a 1099 does NOT mean that you aren't required to report the income. All of your receipts should have been reported on schedule C, part 1, line 1. This includes receipts for which you received a 1099, but is not limited only to receipts for which you received a 1099.

I also own a business from which I derive a second income. I don't receive any 1099's because I'm not a contractor - I'm a manufacturer that sells wholesale - but I'm still required to declare all of my receipts.

But what if they didn't issue me a 1099? Some people did and some people didn't...so how would i report that income for tax purposes if i don't even have a 1099 from them?

Don't you keep books? You realize that if you're audited you'll be required to show your accounting records, right? :blink:

Mr. Ben, you need to learn the rules of what it means to be self employed, if you intend to be self-employed. I think there is a dummies book on how to be self employed.. true ..true. I am not being funny.

Well, I keep the records of who paid me and how much they paid me, but unfortunately I didn't report them this year. I only reported the w-2 and 1099's i received.

Is it too late to adjust my tax return for this year? I realize the deadline for taxes was April 15, but is there something i can do to re-file?

I'm sorry if i am asking stupid questions...but this is all new to me.

No it is not too late to adjust, you can adjust taxes 7 years back. I would advise that you seek the help of an accountant, since you don't have a good understanding of the tax laws. The cost of an good accountant can save you many $$$$$.

You should also look into some accounting software. Peachtree is probably a little too complicated for your needs, but even Quick Books requires some knowledge of accounting in order to use properly. There are plenty of good books on basic accounting that should suffice.

There's no need to feel like an idiot. Nobody is born knowing this stuff, and many get a much tougher lesson than you've gotten. Some people don't learn about the IRS' record keeping requirements until they get audited.

You are actually required to report all income whether there's a 1099 or not. Don't try to BS another self employed person. You chose to pay as little in taxes as possible by cheating. This choice is the reason you're in the predicament you are now. Excuses won't help you and the excuse you're using here won't fly with the Consulate. Try not to bleed to much from the wounded foot. I hope it isn't a fatal wound to your relationship.

You might try showing evidence of your income since the first of the year. That might help your case.

I am willing to pay the additional taxes if that's what it takes to be able to marry my fiance.

I am new to the Self-Employment thing here and didn't completely understand the taxes and money i need to report...I guess that's what i get for listening to other people who obviously don't know what they are talking about. :(
