oh as we said before our friend married 7 months a go to her husband (duh) hes from the DR shes Puerto Rican

We asked in another forum and we got an answer that she would have to live there in order to do a DCF

CHANGE OF PLANS

shes going to be sending out the papers to start the whole process here are some of her questions :whistle:

whats is the poverty guide line ???? she is wanting to bring her husband and his 2 daughters

would she have to use the poverty guideline for Puerto Rico or for the DR ???

a lawyer told her thast for her to bring them she needs a co-sponsor we all know that because of her income ok but this is were it gets a little bit odd .....

she told my friend that in order to have a co-sponsor he/she /they whateverr have to live under the same roof ????? never heard of this before so were asking maybe for the DR is different maybe its not

one of the things she want to know in the tax returnes she has her nieces with her....the lawyer also told her she need a co-spon sor for each other person ( 1for her husband and 1 for each one of the girls)

another thing she told her was that if she found a sponsor that she would use thst persons income and not my friend wich is the wife .... is that even possible ?

any one hats doing a K-3 married to the DR or that has any info PLEASE let us know

March 19 2005 took out my passport now i need to wait

April 19 2005 I GOT MY PASSPORT !!!!

April 21 2005 NENNE booked his flight he get here on June 29th YES!!!!

May 9 2005 I-130 Packet and Packet 3 are being sent off to us !!!

May 15 2005 Recived packet 1-3

June 29 2005 Nenne arrived in Puerto Rico

July 11 2005 Got our Marriage Certificate

Leaving August 17th to Australia and file for DCF !!!

July 19 2005 Got interview date on Sept. 6

August 17th Got to AUSTRALIA !!!

SEPTEMBER 6 DCF (CR1)WE GOT APPROVED !!!!

September 9 2005 Recived VISA in mail

November 24 2005 Nennes POE GUAM

November 26 2005 Arrived in Puerto Rico

Married for 3 years and counting

September 10 2007 sending off the I-571

Sept 2007 sent forms Aug 2008 got 10 yr Green Card

She would use the poverty line for PR... For a family of 4, that's $24,187 for about the next month or so.

The co-sponsor does not have to live under the same roof. The attorney is mistaken. It can be any USC or permanent resident.

You can use the same I-864 for the adult and the two children. Yes, that is true... the co-sponsor would have to have enough income to cover the 3 aliens and their own household. So if there was a wife and 2 kids, the co-sponsor would need an income that covers the poverty limit for 7. If the wife works and wanted to include her income as well, they couls include an I-864A to allow the co-sponsor to use their income as well.

so in other words she is able to use only her co-sponsors taxes she woldnt have to give in hers ????

No, the Sponsor/spouse must also complete an I-864, even if it is insufficient. That means she puts her required 3 years' tax returns in with her I-864.

The Joint Sponsor also completes an I-864, and includes all their proof of income, citizenship and tax returns.

All of the above applies to the underlying Immigrant Visa application.

If she goes with a K-3, it's possible that she might not have to include her returns, but that would depend on the policy of the Consulate in the DR.

K-3 typically uses I-134.

CR-1 must use I-864.
