Timeline

My son and I arrived on 1st of April as K2 and K1 respectively.

We got married on 15th of April.

I tried to apply for SSN today, unfortunately I did not know I am no longer considered as K1 after the marriage.

I was told to get EAD before I could apply for SSN. I had no idea thatI had to apply before our wedding :crying:

Now I feel my actions are limited - such as cannot open bank accounts and apply for drivers license until the EAD then SSN arrives.

Any advise?

Also how can I enroll my son in school without SSN?

Download the special interoffice memo that is available on the SSN VJ Guides section. They should allow the K-1 to apply for a SSN.

The K-2 MUST wait until they receive their EAD or the GC to be allowed to apply for a SSN.

Contact the school admin for what to do in your case to enroll your son; we did with no problems. Make them a copy of this passport ID and visa and I-94 pages if they want "proof" of his status.

No, and if they try to act like that, just don't bring your marriage cert and get it in your maiden name first. You are allowed to get one.

i am sorry i am confused.

we went to social security, i got a service number and when i was called i was asked how they can help me.

i said i am applying for ssn. i gave her my passport and she saw my visa is k1.

she then asked me if i have gotten married after my arrival and i said yes.

she then told me we cannot proceed with the application without the ead since i am no longer considered as k1 since i have married my fiance.

please could you enlighten me?
