Many of you might already read my post and know that I am experiencing a longer process time for my ROC application. I filed i751 last november and still haven't heard the result yet. I am thinking maybe the reason that im expericing longer delay is because i had a long history with the IRS...

in 2001 i came to the US on B2 visiting visa

2002 I was enrolled in college so i had f1 visa

right before i grduated in 2007 we got married and i started applying for permanent residence status... The process of obtaining my conditional green card was pretty smooth.

i can't think of any other reason why im still waiting... i submitted a lot of evidences just like everyone else, any thoughts?

I guess what im looking here is that maybe someone had similar experience and had to wait longer on their ROC process? it will comfort me by knowing im not the only one...

July 2002 - Enrolled in school, obtained F1 Visa

Sept 2007 - Married

Nov 2007 - File for GC

Feb 2008 - Interview - approved

Mar 2008 - received 2 year conditional GC.

11/30/2009 - Applied for ROC

12/15/2009 - received NOA, NOA date 12/10/2009

1/15/2010 - FP appointment

1/17/2010 - LUD

4/18/2010 - Previous I765 LUD

I'm not following you - how do B and F visas have anything to do with the IRS? Or do you mean USCIS? If so, then yes - I can see where possibly they're doing some checking on your previous visas. But that in and of itself doesn't lead me to believe that HAS to be what the delay is. Have you asked your congressman or senator for assistance?

There is another thread running in this forum at the moment where the poster is also seemingly 'stuck'. Have a poke around.

Problems with the IRS (yours) would not preclude ROC at this juncture in the process.

Problems with the IRS may affect the sponsor (and in effect, you) - and then only during the 864 determination, which you are pass, since you have your greencard.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I haven't tried to get the congressman invovled, or gone to any infopass appointment. I thought you have to wait for longer than 6 months after you file (in my case end of may) to inquire about your case with USCIS...

opps that was a big typo - i meant to say INS the old USCIS...

I haven't tried to get the congressman invovled, or gone to any infopass appointment. I thought you have to wait for longer than 6 months after you file (in my case end of may) to inquire about your case with USCIS...

the main reason why im eager to find out about my case is that im planning to travel in late June. I know iits still sometime away but if my case is still pending, i don't feel good leaving the country.

I wasn't sure how long you had been waiting. I agree you aren't likely to get any help until you've passed the 6 month mark.

Why the travel concern? Did you not get the extension letter (NOA1)?

Edited to add: please update your timeline - that may eliminate confusion whenever you start a thread or ask questions. :)

I did receive the one year extention (till feb 2011). im just concerned what if when im outta the country my case is denied will i be able to reenter the country? i know this is probably over kill but this waiting is driving me nuts... i can't help myself but thinking about this every minute.

Your status can only be revoked by an immigration judge - so you would have the opportunity to re-enter the country and appear before said judge. All USCIS can do is issue a NOID (notice of intent to deny).

I think it's best to try not to obsess. All could be well (still have no idea how long you've been waiting!) - it's just them being slow - and you're just worrying yourself for nothing.

I hope thats the case - I worry too much. this is what people called the "immigrant mentality", always assume wrost.

i have bad experience with USCIS. early 2007 i lost all my documents during a big move, passport, social security card and i94, at that time i had f1 visa and i was about to graduate, i needed my original i94 to apply for OPT. so i filed for replacemennt of i94 with the USCIS. twice they sent me back expired versions of i94 with my previous b2 status, so i received something i don't want by paying them ~$600. this makes me believe their system is messed up (at least on my record). lucky me and my then bf were planning on getting married so i went ahead applied for GC.

Same December VSC filer yxo58 haven't got approved yet. You still have a possibility to get approved this week or so, I think...

I'm surprised USCIS made you pay twice for something when it was their mistake to begin with. I would have phoned a supervisor or made an Infopass appointment and asked them to waive the fee for the second time. Generally if the mistake is theirs, they'll do that - you just have to know to ask. Case in point, if you received a green card with a misspelling on it that was their fault - you can file form I 90 to get it replaced but waive the fee due to their mistake.

i went to two infopass appointments for receiving the wrong versions of i94. both times the officers were nice enough to get their managers invovled. they sent emails to higher ups to explain my situation and told me to go home n wait. waiting wasn't the solution since i needed my i94 asap to apply for OPT. anyway, im just glad that part was over since i was able to apply for GC. but now the nightmare is coming back again...

i have email and text alerts set up... now every time i receive an email or text on my phone, im like "is this it?" :wacko:

I dunno - it's not for me to say you're overreacting but - until you hear something or receive an RFE, I don't see a reason to assume something MUST be wrong. Esp. if there's still at least one person (that we know of) who filed around the same time as you who is also waiting.

There shouldn't be any problems for your with what your status was and what it is now. I was on F-1 student visa 7 years before I got married. If they had a problem with your previous status, then your ROC wouldn't have been approved. Certain people take longer, for a reason USCIS only knows. If you don't hear from them in 6 months, you can schedule an infopass and see if they can check into it for you... another option is to get your congressman involved if it is delayed even more.
