Hi there,

For a green card holder living in HK (has re-entry permit renewed), is he qualified to apply for green card for his wife using DCF?

some other questions:

1) how long does the process probably take?

2) can the wife go to the states when the application is being processed?

Thanks,

Karen

Also - it depends on where his wife is from. If she is PRC lass, he must go to USA, file I-130 - is no DCF process for LPR's.

Oh wait - he can file it to the lockbox in Chicago, from HKG, but expect a longish wait (2 years or more) before NVC processing even starts.

I'd be more concerned about him maintaining his , yes HIS, greencard status during all of this.

If she is HKSAR permanent resident, is good chance she can move to Canada, establish residency there, and HE return to USA, then also apply for residency in Canada. Then HE can get to Canada to see her.
