I have 3 years tax transcript 06,07 and 08 on hand. We just filed our tax 2009 yesterday.

My question: Is it okay to submit 06,07 & 08 only? otherwise, anyone please advice. I'm planning to submit my application next week.

Thanks to you!

If you haven't submitted it already, then no its not okay. After April 15, 2010 the "last financial year" became 2009.

Alternatively, if you want to risk it all you'll get is an RFE and it'll slow down your case a little. OR they could what they did to Sven.

If you just filed it, you can also include a copy of your tax return (which you should have), making sure to include all attachments such as W2, 1099's, schedules etc. We did that because we filed but don't have the IRS transcript yet (which I personally prefer) so I will take that will me to the interview.. if we get one.

... p.s. This is for AOS from K1, mine that is

For Naturalization (OP's circumstances) the tax transcripts/returns are submitted to help document the spousal relationship for the 3 year period. There is no financial measurement.

Seems like it would be prudent to include the 09 tax info if available or be sure to have it ready for the interview if no RFE is issued.

It should be OK. You will receive a letter showing that you need to bring tax transcripts as evidence during your interview, so by then you should have 2009 transcripts.

If it makes you feel better, just include a copy of your actual return for 2009 (and it will show a date on it).

From what I know, mailed tax returns should become available in the IRS system within 10 days - so it may be worth waiting another week or two and get the 2009 transcripts from them. You can always ask them to fax a copy (if there is a fax machine close by and handy) and some people asked the officer to wait while you receive the fax to confirm.

No not really, you need to submit 07,08 and 09 now. For 2009 just send in the tax return (1040) and the slips (W2s and any other slips you had)
