I am worried if the CO would really want the original copy of Form 1040 cos my fiance is just sending me a scanned copy of his ITR and email it to me. will this work?

And in CFO seminar, I read that they would be asking for the divorce papers of my fiance. Same as his ITR, he will also sending me his divorce papers via email. Will it cause problem too?

The CO asked for my fiance's 2009 tax return/form 1040, but I didn't have it. He only sent me his W2,cuz he thought it would be enough. I had to go back there to give it to them. They only asked for a scanned copy, so yours will be fine.

Just let him send the original if you still have a lot of time before your interview.

Good luck!

The divorce decree should be a "Certified Copy" of the original.

If he send you a scanned copy it MAY be a problem. Some have gotten by with this some have not. If you don't want to leave it in the hands of a CO get the "Ceritified Copy" mailed to you.

For almost all our documents we had the original and a copy available.

Ask yourself this question,"What is the difference between an original copy and a non-original copy?"

Answer, None. A copy is a copy. Also if you really referring to the original form, only the IRS gets that.

As of Dec 7, 2009, now Zero miles apart (literally)!

For the ITR it wont be a problem....but for the divorce decree it can be a problem as most courts stamp the back of the decree copy certifying it. If it scanned, it will be 2 separate pages. I made sure Mhay had an original stamped copy from the courthouse for the interview....didnt need it there, but she did have to give it to them at the CFO.

@pookie123, I think I answered this for you before, maybe I frightened you with my response.

1) You must have original signatures (not scanned, not emailed, etc...) for the I-134 signature and the signature on the Letter of Intent to marry within 90 days. This addresses the question of signatures being original or copied/scanned for papers from the USC.

2) Then there is the somewhat separate issue of documents (not signatures) what needs to be copies versus originals. In general, you may take copies or provide copies of all documents such as birth certificates, divorce decrees, letters of single status (required in many cases). However the CO can request an original version of a document if he so desires to verify the authenticity or veracity of the document. From postings here, they normally do not but I think if your USC fiance has been divorced you should take the original of the divorce decree and also the original of his birth certificate.

Good luck.
