Waiver to fill ROC after divorce, would it help to have both signatures on form?

Hello all,

My husband and I re getting a divorce but are still in good terms. He is ok to sign the I-751 jointly with me even though we will be divorced. Is that a good idea or should there really be only my signature as I will fill for a waiver to remove the conditions on the green card?

His signature is not required, and it will not help (actually you can't have both signatures and select option D at the same time).<If you're both in good terms, tell him to write you an affidavit letter (notarized) attesting that your marriage was bonafide.

Okalian, I think the OP meant the husband is willing to file with her and sign "married filing jointly" (eventhough they are getting divorced) because they are still "cool" and wants to avoid the potential headache with filing as a devorcee. I think they should go with your answer because it wouldn't be a good idea to try to pull a fast one on uscis. If for some hard luck they get caught, that will be deportation for sure.
