I'm in Vietnam with my wife and we've been traveling.

Yesterday, we got the message from my wife's family that a letter arrived for her. We were told it's a thin letter. So, I told my wife it's just probably one of those "we got your stuff and we'll contact you one of these days."

Actually, it's the letter from the HCM Consulate telling us where to go to download the DS-230, and to submit that to their office (in the first round this went to the NVC). Once they receive it, they say it will be one to three months until the interview.

Needless to say, we are pretty happy! There's a little daylight.

The good thing is that before I left the US, I prepared the new DS-230 for my wife and brought it with me. All she has to do now is to sign it and submit it to the consulate -probably tomorrow. Then, the wait is on for the package and appointment from the consulate.

Q: When my wife gets the package from the consulate with the interview date, will she have to do all steps like the first time around, such as the police report, the medical checkup and so on? Thanks!

When I get home, I will prepare a new I-864 for her to take to the interview.

I hope this inspires some of you who didn't make it in the first round to hold on and persevere: The world does not end with "We are sending your case back to USCIS!"

May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.
[b]DENIED. June 2009: case sent back & received at USCIS[/b]
August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.
February 2010: USCIS contacted & asked for more evidence
March 2010: USCIS re-approved original case.
April 14, 2010: Consulate sends DS-230
June 15, 2010: Interview Date (Blue issued)
July 13, 2010 Placed on AP -yippee!
Sept. 13, 2010 Consulate home visit

Yes she will have to do a new medical and police check. You will also need to update your I-864 support affidavit and get a new letter from your employer.

Tell me more how you got this? My fiance failed interview in oct 09 and I got case closed letter in march. Now I have refiled and expect this to take a year it has already been 2. What form did you file to do this?

Its for CR1/IR1 that were returned to the USCIS and the petitioner filed a rebuttal.

for a new DS-230 - remember - there are 'document requirements' such as birth certificate, police report, marriage certifcate, etc.

Remember that the police report has a 'life' to it - so if it's been more than 1 year since the last police report, get another one.

Don't forget translations and original/photocopy requirements.

HCM might want a new I-864 on interview day, as well, so be prepped for that.

re: the medical - yup - it's been more than 1 year. Need a new one. The good news, though, is that she prolly won't need ALL of the same vaccinations .

my wife did her police report immediately after receiving packet 3. as for medical, your wife can't have it done until she receives packet 4 because she needs to show the interview letter to the medical staff. she should get an appointment asap after getting packet 4 (my wife waited and waited and ended up getting an examination date two days before the interview - that's too close for comfort).

as for I-864, if you can't get a transcript for TY2009 (don't know when they are made available by the IRS, since it is tax season for 2009 - or the end of it), you should have a copy of your return, an employment letter from your employer, and the last three paystubs.

be prepared to pay the $400 IV fee. some had to pay it; but my wife didn't. on the pink sheet, next to IV fee, the CO wrote "waiver". don't know why, and I'm not complaining.

Sorry about your case. Like Kevin said, this is a CR1/IR1 (I-130) case that got kicked back to the U.S. and is now getting another round.
