Section 245(d) of the INA refers to both types of K visas. I don't see any exception that would allow a K3 to adjust status based on marriage to someone other than the petitioner. Where is this allowed in the INA?

As far as I know, it's not allowed to adjust status from K visas as well as crewman's visa.

K visas include K1 (fiancee) and K3 (spouse). It's essential to adjust status from either of these visas after the foreigner arrives in the US. That is exactly what these visas were created for - to allow the foreigner to wait out the green card application while they're in the US. You might be thinking of some other type of visa.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

For K visas - they can't adjust status if they're not married to the petitioner.

For crewman, they can't adjust in the country at all.

M'kay. The bolded part is very important. Your previous post gave the impression that a K visa holder couldn't adjust status at all. :blush:
