Case transferred in California,What to expect?

Hi....

Me and my kids got our Advance Parole last MArch 26 and I got my EAD last April 3,and i got this email from USCIS it said:

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: This case is now pending at the office to which it was transferred.

The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you.

*****

So now my questions are, What do i have to expect on this? are they going to send me a notice for my interview or something?

and How long does it takes for them to process the greencard?

I presume from your message that your package has been transferred to the CSC. Typically, when an AOS package is transferred to the CSC, there will be no AOS interview. Approval may take a bit longer than it might if one were to interview at a local office (this varies), but in general, transfer to the CSC is a good sign. If you got a previous notice that said that your package was being transferred to somewhere other than the CSC, write back with those details.

My wife actually got the same thing recently. There are a couple things I don't understand:

1. If there's no interview, what criteria do they use to decide whether to approve or deny the application? Is it just a "well, this person married on a K-1, and married within 90 days, so she should get the green card" type thing? That's all they have evidence of -- we didn't send any evidence that we are living together or otherwise in a bona fide relationship.

2. Since there's not going to be an interview, there's not going to be a stamp in my wife's passport. If that's the case, how do we know when to apply to lift conditions and eventually to apply for citizenship?

1. Perhaps sufficient evidence was included in the AOS application package, or they figure that the couple has been run through the wringer by the Consulate just recently and passed muster. Gift horses aren't to be looked in the mouths, no man.

2. The green card will have a date on it. Add two years and subtract 90 days, and that will be the time frame for ROC, si man.

Thanks a lot. Your advice is always spot on. I guess I don't understand this, though. "Perhaps sufficient evidence was including in the AOS application package?" No evidence was submitted in the application package, I wasn't asked for evidence of a bona fide relationship so I didn't provide any. Of course I had to submit the marriage certificate with the package, but that's all the evidence they have of our relationship.

One other question: do people generally get RFE's before transfer? I assume not and they transfer the things without looking at them at all, but I'd like to imagine that I'm in the clear.

Nobody is ever perfect, but it does help to think thoroughly, self-edit mercilessly, and only then post, si man.

It could also be a function of volume -- the number of cases that your local office had in the pipeline to process.

Good question. Common sense would dictate that someone would at least glance through for anything glaringly amiss, but the matter of volume might dictate that the file was transferred without anyone's having looked at it. As stated, transfer to the CSC usually means "no interview," but the package can be sent by the CSC back to the local office, for whatever reason (veracity of contents, or the local office has dealt with its backlog, or other).
