Please help.I got two rejection notice

im very stressed and i don't know what to do. i checked all the forms and everything is correct and all the signatures are provided. We send them a check for $1010 to U.S. Department of homeland security..

Rejection notice says

X The entire application package you filed along with any fees you submitted is being returned to you for the following reason(s)

Your application package was submitted with a single remittance and one or more of the application/petitions were unacceptable in the package for the reason(s) specified on the related Notice(s) of action. Please correct the flawed application(s)/petitions(s) and resubmit the application package with the appropriate fees

X Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation.

Did you have the check for the 130 fee?

Why did you send the 130 seperate from the 485?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

In addition to proof of the I-130 petition...

The mentioning of the priority date makes me wonder if the spouse is a US citizen?

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Why did you send the 130 seperate from the 485?

I send the I-130 few days early because i didn't have enough money for the I-485. and i send it later. I didn't have an NOA receipt to send with the I-485 so instead i send them the copy of the check.. Yes my husband is a US citizen. He was born in oregon and he's been in the navy for 5 years.

i finally have the I-130 NOA. im sending the copy with the I-485. And two checks. one for $930 and the other for $80.. Am i correct

hi,

this happened to us, we sent the packages to different offices by fedex. We got the I-485 packet back but the I-130 was processed. wait for the NOA that shows proof of I-130 filing and send the packet back to them. Hopefully the spouse is USC then you can get the A# immediately.

I didn't see the NOA1 for the I-130 in your list. Everything else looks fine. They can't process the I-485 without proof of your right to apply to adjust status (eg priority date) so sending the copy of the cheque for the I-130 is of no use to them. Now that you have the NOA1 for the I-130 you need to send them a copy as it will provide a basis on which you can adjust status.

I am surprised they quibbled about the single cheque for the application fee and the biometrics but there have been a few others who have had the same thing happen, lately. You should be fine with the two cheques as well. Write on the bottom of each what they are for.

i got confuse now, i'm in the process of filing aos... i came here jan 2009 and married march 2009 and will just send my application hopefully by the end of this month.

do i have to send i-130 as well? i used the guides here in vj and used all the forms here for aos but didn't have i-130

now im so confuse.

pls help

The OPs case is different from a normal K1. Do not confuse yourself and just follow the guide for AOS from K1.

quick question. someone just told me that i can't send my I-485 with a pending I-130. she said i would have to resend a new I-130 with the I-485 but they're going to the same place. I called the military line and they told me to just send my I-130 NOA with the I-485.. has anyone send their I-485 with a pending I-130. i didn't think it was a problem

Just send your I-485 with your I-130 NOA. Your I-130 was already accepted and you have a receipt for it.
