Ok my fiance has his waiver appt this morning. He called me and said everything went good that his appt was for 9am and he was back home by 10:30. I of course asked what the officer said to him and he said nothing just asked for the waiver papers and hardship letters. Then she just said ok just go to the DHL. At the DHL window they got him to fill out a couple of papers and asked for his passpot, gave him a number to call and said to give it until this coming Friday and he should get a package with paperwork.

My question is what does that mean? Does it mean that he's got the visa or no?

It means that you will be notified of a decision via DHL. The passport is always taken at the waiver interview with the waiver packet. When everything is ready at DHL(usually in a few days), they he will pick up the envelope. If he is approved, the passport with visa along with paper to hand in at the border will be inside. If he is not approved, there will be directions to send in additional evidence along with his passport(no visa).

About 50-60% of waivers are approved "immediately" in Juarez whereas the rest will go through the regular process which is ranging anywhere from 11 to 18 months currently. During that time, you would have to send in additional extreme hardship evidence if you want to be approved.

I can't imagine why they'd keep his passport if they weren't going to issue a Visa...

it doesn't work that way when a waiver is needed. All passports are taken and returned by DHL. Whether or not the visa is issued depends on if the extreme hardship waiver was immediately approved or not.
