Went for my K1 interview the other day.Was surprised when the CO told me that he could not give me a visa because he says the income of my fiance was insufficient.In the income tax of my fiance the adjusted gross income was 917.My fiance is receiving his Social security, Pension, has income from his business and income from employment.Add all of those and it was "more" than enough to support me. I told the Co that he has income in his business and receiving monthly from Social security and pension. He says it doesnt matter.So he told me to get my docs at window 37.They gave me a white paper,checked was for me to submit an original copy of Affidavit of support and a valid passport.Is social security and pension not considered an income? I have already submitted those docs and was told that they will let me know. I wonder how long?

If you provided both a tax return AND a statement of benefits from Social Security, they will consider his income to be the Social Security annual amount plus the amount from line 22 of his 1040 tax return. What do those two items add up to?

i am just curious, does your fiance income is 125% above poverty line?

Hi! Straight Talk, line 22 is 917 + 23,561(social security benefits)=$24,478.

I went back to the embassy on April 12 to submit his affidavit of support I attached his employment certificate which indicates his income for 2009 as $28,971, his business card , social security statement and pension statement. It is now 19 days and haven't heard from the embassy.

You may have a problem. It sounds like he is running his own business. He would typically file Schedule C with his 1040 tax form. It seems like his total income is about 67,000+ if I did not double count income sources.

But then Line 12 of the 1040 is the Business Income (Loss). I suspect he had a 66,000 loss or -66,000 on line 12 reducing line 22 to about $917.

In other words he had such a high business loss, his Total Income for Line 22 is $917.

He alone is not eligible to sponsor you. Sometimes the Embassy in the Philippines will not accept a joint sponsor.
