Hi VJ smiley-greet013.gif

I have questions, and this is the best place for the answers. (L)

So here goes...

Would the embassy give a visa applicant a blue slip requesting they return with an I-601 form (provided by them) a hardship letter from me, and the $545 fee, if the applicant was not even eligible for a waiver?? :blink:

I was really shocked and excited when he told me they gave him waiver paperwork! :wow:

But now that I have it, and I am reading what they gave him, I am concerned...

On the refusal worksheet it says only the paragraphs marked pertain to your visa application...

There is a check mark next to the section of the Immigration and Nationality Act that pertains to us.

It describes the details of why he is inadmissible, and in the same paragraph says a waiver may be available.

Further down the page it has a place to check mark that says "You are eligible to apply for a waiver of the grounds of ineligibility."

This section is NOT checked.

Everything I have read and researched says that he is NOT eligible for a waiver!

So would they make him come back with all this paperwork and money if he was not eligible??

Is it possible for the embassy to even accept an application for waiver when the applicant is not eligible for one? :wacko:

Am I going blind reading example hardship letters, and immigration law codes for nothing??? :blink:

:crying::help::crying:
