I sent out the I130 today for the k-3 visa. Was this wrong to do? I am reading that there is no more k-3 visa. So what do i do from here? Does it automatically get converted into a cr1 visa? Do i send in the i129f also because reading these threads it says to no longer send out the i129f? How long are the approvels of the cr1? i guess you need to pay all the fees ahead of time also? please help me..

The CR-1 is the I-130 petition. Don't file for the 129F (that would bring you to a K3 - no longer processed by NVC).

Did you send the check with the I-130 fee? This is all you have to pay for now.

Exactly! Just wait! The approval should come in about 3-6 months!

Good luck!

I CAN'T DO ANYTHING UNTIL I RECEIVE A CASE NUMBER. I ALREADY HAVE DONE THE 864 FORM AND I ALREADY HAVE ALL THE OTHER FORMS. I SENT THEM MY MARRIAGE CERTIFICATE ALREADY AND HER PASSPORT COPIES AND BIRTH CERTIFICATE. THE DS 3032 CAN'T BE DONE UNTIL WE GET A CASE NUMBER I AM ASSUMING.

Yes the link I sent you is the next steps AFTER your I-130 is approved by USCIS.

You can start gathering the documents if you haven't yet. If you have, then just wait.

Hope you get your approval soon!

Just fyi, you will need to submit new police certs (though depending how long exactly it has been since they were issued, you might get away with copies) and probably do a new medical too.

well a long story on why we applied for a fiance visa. she was approved for it and was living here for months and we got married within 90 days. she got her police reports last july and medical last july. so now we have to start all over again because she went back for an emergency and can not come back. so we need to do the process all over again but they already have done everything on us already so i am hoping it will be faster because of this.

Rich - it used to be -

in order to get a K-3 in play - one needed to file an I-130 - then when the receipt of notice came in on the I-130, one sent in the I-129F for the K-3 visa.

The K-3 now is administratively closed at NVC, if it travels from USCIS with the I-130 petition. This change went into effect on 1 FEB 2010 - it's just something you missed - don't sweat it - it's difficult to monitor USCIS news, most of the time.

For now, focus solely on the I-130, and GOOD LUCK ! If all goes wll, she'll receive a CR-1 visa on or after interview day.

roughly 5 months for I-130 approval,

then 1 to 2 months at NVC

then anywhere from 1 to 4 months for interview date.

Take a look at the timelines for Brazil - click yer flag under yer name - that'll drop you to the Brazil Portal.

Then click on CR-1/IR-1 timelines on the left. Once you have that timeline up - click in the NOA-2 date to sort by NOA-2 date -

THEN STUDY THE DATA..

That will give you a good idea of what prior filers had, for durations. Good Luck !
