Hello everybody,

Here is my situation: entered US in Dec 2008 on K-3 visa. Planning to apply for AOS this June but having trouble meeting income requirements. The income of my husband (sponsor) for the most recent year is below poverty line. But previous two years more than 125% above poverty line. Right now he has a good job and makes above poverty. No assets, no big savings. Cannot get a co-sponsor, husband's parents do not wish to sign for me, no friends that can do it either. Was anybody in the same situation and got approved without getting a co-sponsor? I am also looking for a job right now, if I do get a job and we include my income will it help?

Another question: is there a validity period for I-130(was approved back in Sept 2008)?

What the previous year's tax returns say and what your sponsor currently earns are two different things - what IS evaluated is what they currently earn (this could be verified by providing Pay Stubs, for example.)

I would also add a letter from the employer stating hire date, salary, type of employment, along with those paystubs.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
